HomeMy WebLinkAbout09 147 Hanover Police Services Board Dispatch Agreement By-Law e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2009 - 147 BEING A BY-LAW TO ENTER INTO AN AGREEMENT FOR COMMUNICATIONS AND DISPATCH SERVICES WHEREAS Section 20 (1) of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that a municipality may enter into agreements with one or more municipalities to jointly provide, for their joint benefit, any matter which all of them have the power to provide with in their own boundaries; AND WHEREAS pursuant to the said Act, Sections 8 (1) and 9 provide that the powers of a municipality under this or any other Act shall be interpreted broadly so as to confer broad authority on the municipality to enable the municipality to govern its affairs as it considers appropriate and to enhance the municipality's ability to respond to municipal issues and that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS the Paisley & District Fire Department provides fire protection in certain areas of the Municipality of Kincardine as well as the Municipality of Arran-Elderslie and the Municipality of Brockton; AND WHEREAS the Paisley & District Fire Department Joint Board of Management has determined that dispatch services for the Paisley Fire Department be provided by the Hanover Police Services Board dispatch who operate a twenty-four hour communications and dispatch centre for the purpose of providing service to emergency agencies; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine deems it advisable to enter into an agreement with the Hanover Police Services Board, the Paisley & District Fire Department Joint Board of Management, and municipalities served by the Paisley & District Fire Board; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That The Corporation of the Municipality of Kincardine enter into a joint agreement with The Corporation of the Municipality of Arran-Elderslie, The Corporation of the Municipality of Brockton, the Paisley & District Fire Department Joint Board of Management and the Hanover Police Services Board for the provision of twenty-four hour communications and dispatch services to be provided to the Paisley & District Fire Department. 2. That the Mayor and Chief Administrative Officer be authorized and directed to execute by affixing their signatures and the corporate seal, on behalf of The Corporation of the Municipality of Kincardine the dispatch agreement attached hereto as Schedule 'A' and forming part of this By-law. e e e e Page 2 Hanover Police Services Board Dispatch Agreement By-law By-law No. 2009 - 147 3. This by-law shall come into full force and effect upon its final passage. 4. This by-law may be cited as the "Hanover Police Services Board Dispatch Agreement By-law". UW~~~~e~RYOrl READ a THIRD TIME and FINALLY PASSED this th day of October, 2009. ct;)L ~ayo u DUo iCiIrl ,1.'1 ~ R:)JD [) ~1 Clerk " } , FIRE DEPARTMENT DISPATCH AGREEMENT THIS AGREEMENT made this day of ,2009 BETWEEN: HANOVER POLICE SERVICES BOARD Hereinafter referred to as the "Board" -and- PAISLEY & DISTRICT FIRE DEPARTMENT JOINT BOARD OF MANAGEMENT Hereinafter referred to as the "Department" -and- THE CORPORATION OF THE MUNICIPALITY OF ARRAN-ELDERSLIE THE CORPORATION OF THE MUNICIPALITY OF BROCKTON THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE Hereinafter referred to as the "Municipality" WHEREAS the Board presently operates a twenty-four hour communications and dispatch centre for the purpose of providing service to emergency agencies. AND WHEREAS the Board and the Department desire to enter into an agreement whereby the Department would be served by the Board's dispatch centre for answering and dispatching of the Municipality's Department for emergency purposes. NOW THEREFORE THIS AGREEMENT WITNESSES THAT: 1. All calls received by the Board's Dispatch Centre through 9-1-1 or other telecommunications means will be promptly acknowledged and dispatched. 2. The Dispatcher will page/dispatch the Department in accordance with Schedule "A" attached hereto. 3. The Dispatcher will dispatch the Department to reported medical first response emergencies according to the Letter of Understanding entered into between respective County and the Municipality. 4. The Department will provide a signed copy ofthe Letter of Understanding between the Municipality and the respective County prior to initiating this agreement. 5. The Municipality will consult with the Board prior to amending the Letter of Understanding previously referred to between the respective County and the Municipality. 6. The Department will provide the Board with a "current" call-out list of firefighters for utilization in the event a page-out or dispatch is unsuccessful after two attempts. The Department will also provide the Board with "current" information regarding the Department's office phone number, fax number, e-mail address, registered Radio Call Sign and updated County generated 911 maps. 7. The Dispatcher will, in the event of a failure to successfully dispatch firefighters to a reported emergency, initiate the process of contacting firefighters from the list provided by the Department. 8. Once contact is made and the emergency message relayed, the firefighter dispatched will be responsible for contacting additional assistance required to assist with the emergency. , ' Dispatch Agreement cont'd....page 2 9. Equipment related to the system and presently owned or hereafter acquired by the Board or Department and installed in its buildings or vehicles or carried by its staff shall be properly maintained and kept in good working order at the expense of the party owning the equipment. 10. Any defect or condition that may cause a failure in the system shall be reported to the Chief of Police and/or designated alternate of the Hanover Police Service immediately. . 11. The Department agrees to pay for the cost of any telephone lines required, long distance calls made on behalf of the Department, costs incurred to the Board to provide proper mapping including travel and wages and any changes made to the coverage area whereby Bell Canada 911 or OPP Geographic Information Services invoice the Board relative to emergency dispatch services. Such costs will become due and payable upon receipt of an invoice. 12. If either party to this agreement wishes to terminate the agreement they shall give a minimum of twelve months' notice in writing of their intention to do so. Termination shall become effective on the date agreed upon by the parties and may only be extended on mutual consent of the parties and in monthly increments. Both parties to the agreement are bound by the terms ofthis agreement until date of termination. 13. Capital equipment costs are not anticipated for the successful operation of this service, however, any capital costs necessary to provide this service shall be borne by the Municipality. 14. The cost per capita annually to the Municipality for the paging/dispatch service as set out in Schedule "A" hereto attached is based on current population data obtained through The Ontario Municipal Directory. The fee for any part of a calendar year will be pro-rated on a monthly basis. 15. The Board agrees to provide the service covered by this agreement for the stated fee until December 31s', 2010 after which the parties involved will review the terms of the agreement and in writing confirm any changes in level of service and/or fees for service. 16. Billing for this service will be provided in January of each year and is due and payable on receipt of invoice. 17. In the event oftermination of this agreement by either party, the Board shall retain all equipment of the Board, including records and the Municipality shall have no claim or entitlement to reimbursement for any part thereof. 18. The Board will, during the term of this agreement, exercise due diligence in providing the agreed upon level of service and operation of the service. 19. The parties agree that the Board shall have no liability to the Municipality as a result of failure of the system to operate, or as a result of any act or omission by any employee in the operation of the said system. 20. The Municipality agrees to indemnify and hold harmless the Board, its employees, agents and servants and the Chief of Police from all manner of actions, causes of actions, suits, claims and demands whatsoever that may be made against them as a result of the performance of their duties on behalf of the Municipality and as agreed to in this agreement. , . \' '" Dispatch Agreement Cont' d. "..page 3 21 The Municipality shall provide liability insurance minimally in the amount of two million dollars to insure the indemnity contained in this agreement and shall ensure that the Board is stated in the contract of insurance as a co-insured. 22 The Board shall act as the exclusive agent with respect to all matters relating to this agreement and the Municipality shall not enter into any other dispatch service agreement which would be in conflict with this agreement.
