THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2009 -126
BEING A BY-LAW TO DESIGNATE THE PROPERTY AT 7 MCKAY STREET,
MUNICIPALITY OF KINCARDINE (FORMER VILLAGE OF TIVERTON) AS
BEING OF HISTORIC OR ARCHITECTURAL VALUE
WHEREAS Section 29 (1) of the Ontario Heritage Act, R.S.O. 1990, c. 0.18, as
amended, authorizes the Council of a municipality to enact by-laws to designate a
property within the municipality to be of cultural heritage value or interest;
AND WHEREAS the Council of the Municipality of Kincardine has caused to be served
on the owner of the lands and premises known as the property at 7 McKay Street,
Municipality of Kincardine and upon The Ontario Heritage Foundation, notice of intention
to so designate the aforesaid property and has caused such notice of intention to so
designate the aforesaid real property to be published in a newspaper having general
circulation in the Municipality;
AND WHEREAS the reasons for designation are set out in Schedule "B" attached
hereto;
NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine
ENACTS as follows:
1. There is designated as being of architectural value and interest the real property
more particularly described in Schedule "A" hereto, known as the property at 7
McKay Street, Municipality of Kincardine, Ontario.
2. That By-law No. 2009 -116 be hereby repealed.
3. The Clerk is hereby authorized to cause of copy of this by-law to be registered
against the property described in Schedule "A" hereto in the proper land registry
office.
4. The Clerk is hereby authorized to cause a copy of the by-law to be served upon the
owner of the aforesaid property and upon The Ontario Heritage Foundation and to
cause notice of this by-law to be published in a newspaper having general
circulation in the Municipality of Kincardine.
5. That Schedules "A" and "B" attached hereto form part of the by-law.
6. This by-law shall come into full force and effect upon its final passing.
7. This by-law may be cited as the "7 McKay Street Heritage Designation
By-law" .

The property is described as "Lot 1 & Part Lot 2 Plan 104 McKay W IS",
Roll # 41 08 260 006 18400 0000.
The said lands have a site area of 1 .22 acres.

Schedule "B"
Designation shall be effective for all four exterior facades and the green space as
required by the minimum Municipal setbacks.
Structure is a large ltalianate 5 bay, centre hall, two and a half storey school, built
in 1875-6 by local builder George McClelland; likely one of the earliest brick
buildings in Tiverton. Build of Local yellow brick with elephant low arch windows
and arched protruding central entrance bay raising the entire two and half storey
height.
Built in 1875 to replace previous outgrown and inadequate school facilities, this
building served the children of Tiverton from 1876 to 1951. Alumnus, Eleanor
Thompson says in her letter, "This building has added its own dimensions to the
life of the village and surrounding communities. Its existence was a vital factor in
the lives of all the students who emerged from its halls of learning. Without it,
many of the young people of the day would have had to forgo any hope of
academics at the secondary...(level)."
