HomeMy WebLinkAboutKIN 87 052 Versa Care Rezone THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 1987-52 e A BY-LAW TO AMEND BY-LAW NO. 4350, AS AMENDED, IN ORDER TO REZONE BLOCKS B, C & G AND PART OF BLOCKS A, F AND H, PLAN M-l TO R5-l WHEREAS Section 34 of authorizes the councils zoning by-laws; The Planning Act, s.o. 1983, Chapter 1 of municipalities to enact and amend AND WHEREAS the Council of The Kincardine has enacted By-law 4350, a Section 34 of the said Planning Act; Corporation of the Town of zoning by-law enacted under AND WHEREAS the Council of The Corporation of the Town of Kincardine desires to amend such by-law; NOW THEREFORE the Council of The Corporation of the Town of Kincardine ENACTS as follows: 1. Section 12 of By-law No. 4350, as amended, being the zoning By-law for The Corporation of the Town of Kincardine is hereby further amended by adding the following Subsection 12.43 to Section 12 thereof: 12.43 Notwithstanding their 'R5' Zoning designation, those lands described a Blocks B, C and G, Part of Blocks A, F and H, Plan M-l, (Parts 1 and 4, Plan 3R-3793), in the Town of Kincardine, and identified by the zone symbol 'R5-1' on Schedule "A" to this By-law, may be used for a multi-level retirement facility and uses accessory thereto, in compliance with the 'R5' zone provisions contained in this By-law, excepting however that: i) for the purposes of this sub-section a "multi-level retirement facility" shall mean any building or structure other than a private or a public hospital where elderly persons may reside in apartment-type, lodge- type or nursing home accomodations; and where common facilities for the preparation and consumption of food are provided, and common lounges, recreation facilities and other basic housekeeping services as well as medical care may also be provided; and, which the nursing home portion is licensed by the Province. ii) the minimum lot area shall be 2.5 hectares; i i i) the maximum exceed three number (3) ; of storeys shall not iv) Section 5.5.2.11 shall not apply; . v) the off-street Section 4.12 shall that: parking apply, requirements of excepting however a) off-street parking may be permitted in all yards, provided that no part of any parking area is located closer than 1.0 metre to any street line; page 2 1987-52 b) for the purposes of this by-law "PARKING SPACE" shall mean an area of not less than 17.4 square metres, having minimum dimensions of 2.9 metres by 6 metres, exclusive of any isles or ingress lanes, for the temporary parking or storage of motor vehicles, and may include a private garage. . c) there shall be one (1) space for each apartment dwelling unit plus one (1) space for every four (4) apartment dwelling units or fraction thereof, to be set aside for and visually identified as visitors parking; and d) there shall be one (1) space for each three (3) beds in a lodge or nursing home, or fraction thereof, of which a minimum of two (2) parking spaces, each with minimum area of 21.6 square metres and minimum dimensions of 3.6 metres by 6.0 metres shall be provided for the parking of passenger vehicles used in the transportation of wheelchair users and the ambulant disabled; and e) there shall be one (1) space for every 10 beds in a lodge or nursing home for uses not otherwise specified herein. 2. Schedule "A" of By-law No. 4350, as amended, is hereby further amended by changing thereon from 'R3' (Residential Three) to 'R5-1' (Residential Five Special) the zoning designation of those lands described as Blocks B, C and G, Part of Blocks A, F and H, Plan M-l, (Parts 1 and 4, plan 3R-3793), in the Town of Kincardine and shown outlined by the heaviest black broken line on Schedule "A" to this By- law. 3. This By-law takes effect from the date of Council and comes into force pursuant to the The Planning Act, S.O., 1983 Chapter One. passage by the provisions of READ a FIRST and SECOND time this 3rd day of September, 1987. ~~ .
