THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW NO. 1987-69

A BY-LAW TO AMEND BY-LAW NO. 4350, AS AMENDED, IN ORDER
TO REZONE PART OF PARK LOT 8, WEST SIDE OF PARK STREET,
PLAN 61, LOT 23, PLAN M-35 AND PART OF THE PARK STREET
ROAD ALLOWANCE TO Rl-9
WHEREAS Section
authorizes the
zoning by-laws,
34 of The
councils
planning Act, s.o.
of municipalities
1983, Chapter 1
to enact and amend
AND WHEREAS the Council of The Corporation of the Town of
Kincardine has enacted By-law 4350, a zoning by-law enacted under
Section 34 of the said Planning Act,
AND WHEREAS the Council of The Corporation of the Town of
Kincardine desires to amend such by-law,
NOW THEREFORE the Council of The Corporation of the Town of
Kincardine ENACTS as follows:

By-law No. 4350, as amended, being
By-law for The Corporation of
hereby further amended by adding
12.39 to Section 12 thereof:

the following Subsection
12.39
Notwithstanding their 'Rl' zoning designation,
those lands described as Part of Park Lot 8, West
Side of Park Street, Registered Plan No. 61, Lot
23, plan M-35 and Part of the Park Street Road
Allowance, Town of Kincardine, and identified by
the Zone symbol 'Rl-9' on the Schedule "A" of this
By-law shall only be used for the purposes of a
single detached dwelling and uses accessory
thereto, in compliance with the 'Rl' Zone
requirements, excepting, however, that:
(i) For the purposes of this subsection, a lot
shall be the whole of Lot 23, plan M~35, Part
of Park Lot 8, west side of Park Street, Plan
61 and part of the Park Street Road Allowance
as identified by the heaviest black broken
line on Schedule "Aft to this by-law.
2. Schedule ftAft of By-law No. 4350, as amended, is hereby
further amended by changing thereon from 'Rl' and 'D' to
'Rl-9' the zoning designation of those lands described as
Part of Park Lot 8, West Side of Park Street, Registered
Plan No. 61, Lot 23, Plan M-35 and part of the Park Street
Road Allowance in the Town of Kincardine, and which are
shown outlined by the heaviest black broken line on the
Schedule "Aft of this by-law.
