THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 1987-80 A BY-LAW TO AUTHORIZE THE EXECUTION OF A TAX ARREARS EXTENSION AGREEMENT PURSUANT TO SECTION 8 OF THE MUNICIPAL TAX SALES ACT, 1984, S.O. 1984, c. 48. WHEREAS The Corporation of the town of Kincardine has registered on the 7th day of October, 1987, a tax arrears certificate against the land described in Schedule wAw attached hereto and forming part of this by-law, AND WHEREAS Section 8 of the Municipal Tax Sales Act 1984 provides that a municipality may by by-law authorize an agreement with the owner of such land to extend the period of time in which the cancellation price payable on the land is to be paid, NOW THEREFORE the Council of The Corporation of the Town of Kincardine ENACTS as follows: 1. THAT an agreement be entered into by the Corporation with Joan Johnstone, the owner of the land described in Schedule wAw to extend the time period in which the cancellation price payable on this land is to be paid beyond November 7, 1988. 2. THAT the agreement be in the same form and contain the same terms and conditions as set out in Schedule wBw attached hereto and forming part of this by-law, 3. THAT the mayor and treasurer be authorized to enter into the agreement on behalf of the Corporation, 4. AND THAT this by-law becomes effective as of the date of the final passing hereof. In the Town of Kincardine, in the County of Bruce, and being composed of: FIRSTLY: Subdivision Lot 8, Plan 61 of Lot 8 on the North side of Durham Street, in the Town of Kincardine and part of Lot 1 on the West side of Queen Street in that part of the Town of Kincardine formerly known as Williamsburg and now according to Plan 4 and more particularly described as follows: COMMENCING at the Southeast angle of Subdivision Lot 81 THENCE Westerly along the Southerly limit of Subdivision Lot 8 a distance of ninety feet (90') more or less to the Westerly limit of Subdivision Lot 81 THENCE Northerly along the Westerly limit an extension thereof a distance of Ninety-five feet (95') one inch (1-) to the Northerly side of the Northerly wall of the machine shop now erected on the said landsl THENCE Easterly and parallel with the Northerly limit of Subdivision Lot 8 a distance of Ninety feet (90') more or less to the Easterly limit of Lot 11 THENCE Southerly along the Easterly limits of Lot Subdivision Lot 8 to the point of commencement. 1 and TOGETHER WITH the right to the use of the chimney on the boiler factory to the North and West of the said property provided that the cost of repair to the said chimney shall be divided equally between the grantee herein and The Corporation of the Town of Kincardine or its assigns.
