THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW NO. 1987-2
BEING A BY-LAW TO ENTER INTO AN AGREEMENT FOR SERVICES OF A SMALL
ANIMAL CONTROL OFFICER FOR 1987.
WHEREAS, The corporation of the Town of

1. The mayor and clerk are hereby authorized, on behalf of The
Corporation of the Town of Kincardine to sign an agreement
with Steven Nisbett for small animal control services for
the year 1987.

THIS AGREEMENT made in duplicate this 8 day of January
1987,
BETWEEN:
THE CORPORATION OF THE TOWN OF KINCARDINE
(hereinafter called "the Town")
OF THE FIRST PART
-AND-
STEVEN NISBETT of the Township of Kincardine
in the County of Bruce
(hereinafter called "Nisbett")
OF THE SECOND PART
WITNESSETH that the parties hereto have agreed as follows:
1. For the purpose of this agreement:
a)
"SMALL ANIMALS" means dogs, cats
which are making a nuisance

2. NISBETT is hereby appointed SMALL ANIMAL CONTROL OFFICER for
the Town of Kincardine.
3. It shall be the duty of the SMALL ANIMAL CONTROL OFFICER to
enforce all the by-laws of the Town of Kincardine and all
the acts of the Provincial Legislature concerning the
control of animals.
4. The SMALL ANIMAL CONTROL OFFICER shall have all necessary
authority for the seizure and impounding of small animals as
may .be required by the said by-laws or acts and shall take
instructions from the chairman of the committee for
Protection to Persons and Property or in his absence the
clerk-adminstrator of the Town of Kincardine.

The SMALL ANIMAL CONTROL OFFICER shall work a minimum
of 15 hours per week, of which he shall patrol not less
than 3 hours per day and not less than 4 days per week.
b)
The SMALL

a description of said animals.
c) The SMALL ANIMAL CONTROL OFFICER shall submit to the
clerk's office no later than the 2nd day of each month,
a written statement of his activities for the past
month on the prescribed form.
6.
The SMALL ANIMAL CONTROL OFFICER shall, in addition to his
normal patrol, be responsible for the care of all animals so
impounded in the TOWN'S small animal shelter and be
responsible for the cleanliness of said shelter pursuant to
provincial regulations.
Duties of poundkeeper are appended as Schedule "A".
7. Cost of feeding and destroying the impounded animals shall
be borne by the TOWN with invoices submitted in the name of
the Town of Kincardine to the treasurer's office for
payment.

8.
The SMALL ANIMAL CONTROL OFFICER shall, at his own expense:
a) Supply transportation in the performance of his duties.
b) Dispose of the carcasses of dead dogs, cats and other
animals subject to all health and other regulations.
9. The SMALL ANIMAL CONTROL OFFICER shall have the cooperation
of the Kincardine Police Department when issuing any
summons, and shall cooperate with them notifying them when
he is going on patrol.
10. The term of this Agreement shall be for one year, commencing
on the 1st day of January, 1987 and terminating on the 31st
day of December, 1987. This Agreement may be terminated by
either party upon thirty (30) days written notice to the
other.
11. The SMALL ANIMAL CONTROL OFFICER shall be paid at the rate
of SEVEN HUNDRED AND TWO DOLLARS and FIFTEEN CENTS ($702.15)
per month for the term of this agreement.

SCHEDULE "A"
DUTIES OF THE SMALL ANIMAL CONTROL OFFICER
Maintain every room in the pound in a clean condition.
Ensure that the pound is adequately ventilated.
Ensure that adequate heat is provided for the comfort
of every animal in the pound.
Ensure that every animal is properly indentified and that
a comlete record is maintained on each animal.
Pens are to be properly sanitized.
Properly clean and flush any gutter or drain in the pound.
Ensure that adequate lighting is provided in the pound.
The following method should be used in cleaning the pens:-
a) Loose feces or urine to be removed from the pen.
b) Fecal material and dirt should be removed from wall
and floor of the pen by using a stiff bristled broom
or handbrush.
c) Pen walls, floor and rest board should be sprayed
with a suitable disinfectant.
d) The entire pen should then be rinsed with hot water.
e) Pen doors should be sanitized in a similar manner.
f) The floor area of the pen should be squeegied to
remove excess water.
g) Animals to be removed from their cages during cleaning
procedure.
9. Adequate amounts of suitable feed and water are to be
provided to each animal.
10. Every container for feed or water shall be maintained in
a sanitary condition.
11. Impounded animals bearing identification are to be reported
to the nearest office of the Ontario Society for the
Prevention of Cruelty to Animals, or any Society affiliated
therewith.
12. Dispose of animals following the minimum redemption ,periød
which shall not be less than three day, excluding the day
on which the animal was impounded and any holidays.
13. Euthaniasia of dogs must be performed in accord with
Section 20, 21 and 22, Ontario Regulation 140/71.

14.
Generally, the Poundkeepter is responsible to ensure the
construction of the'pound and care of the animals in the
pound are in accord with Ontario Regulation 140/71 and the
Animals for Research Act.
