A BY-LAW TO SELL A PORTION
OF THE SAUGEEN STREET ROAD
ALLOWANCE
WHEREAS By-law 1987-11 closed and stopped up Part of the East
Part of Saugeen Street between Harbour Street and the Kincardine
Harbour;
AND WHEREAS Section 298 of the Municipal Act, R.S.O., 1980,
Chapter 302, as amended authorizes the council of every
municipality to sell the soil and freehold of a stopped-up
highway or part of a highway;
AND WHEREAS Section 316 of the Municipal Act, R.S.O. 1980 Chapter
302, as amended, requires that where the whole or any part of a
highway is legally stopped up, if the Council determines to sell
such original allowance or such stopped-up highway, the price at
which it is to be sold shall be fixed by the council, and the
owner of the land that abuts on it has the right to purchase the
soil and freehold at it at that price;
AND WHEREAS 634467 Ontario Inc. is the adjoining land owner to
the portion of Saugeen Street being closed and stopped up;
AND WHEREAS 634467 Ontario Inc. is interested in purchasing the
lands hereinafter described and have entered into an Agreement of
Purchase and Sale with The Corporation of the Town of Kincardine;
NOW THEREFORE the Council of The Corporation of the Town of
Kincardine ENACTS as follows:
1. Council authorizes the sale of the said lands described
in Schedule "A" attached hereto to 634467 Ontario Inc.
on the terms and conditions as set out in an Agreement
of Purchase and Sale attached hereto as Schedule "B".
2. The mayor and clerk are authorized to execute such
documents as they may deem adviseable to convey said
lands to 634467 Ontario Inc. or as it may direct in
accordance with the terms and conditions as set out in
an Agreement of Purchase and Sale attached hereto as
Schedule "B".
3. The purchase price of the said land shall be fifteen
thousand dollars ($15,000.00).
4. The clerk of The Corporation of the Town of Kincardine
is hereby authorized and instructed to register a copy
of this by-law in the Registry Office of Bruce (No.3)
in Walkerton, Ontario.

5.
This by-law shall not take effect until all the terms
and conditions of the Agreement of Purchase and Sale
attached hereto as Schedule "B" have been fulfilled.

SCHEDULE "B"
This Offer is conditional until closing on the Vendor and
the purchaser coming to a satisfactory development agreement
regarding the purchaser's proposed condominium project on
Lots 4, 5 and 6, Plan 77, failing which this Offer shall
become null and void and the Purchaser's deposit shall be
returned to them in full without interest or deduction.
2. The purchaser shall be responsible for all survey costs
including a Reference Plan if necessary.

The purchaser shall be responsible for all legal costs
associated with this sale.
This Offer is conditional upon the vendor obtaining
satisfactory arrangements allowing public access to the
Harbour Location Reserve shown as Part 1, plan 3R-302 and
that James Charles Drury Cottrill forfeits his License of
Occupation '5325 with the Ministry of Natural Resources.
This offer is also conditional upon the vendor obtaining
necessary approval for the closing of the subject lands
shown as part of Saugeen Street on the Plan of Survey by
John C. Wood dated January 29, 1986 and as shown on Schedule
"A" to this Offer to purchase, Agreement of Purchase and
Sale.
