THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW NO. 1987-28
A BY-LAW TO AMEND BY-LAW NO. 4350 AS AMENDED, IN ORDER
TO REZONE PART OF PARK LOTS 7 AND 8, SOUTH SIDE OF KING
STREET, PLAN 4, IN ORDER TO PERMIT A GROUP HOME FOR THE
MENTALLY HANDICAPPED OPERATED BY THE KINCARDINE &
DISTRICT ASSOCIATION FOR THE MENTALLY RETARDED
WHEREAS Section 34 of
authorizes the councils
zoning by-laws;
The Planning Act, S.O. 1983, Chapter 1
of municipalities to enact and amend
AND WHEREAS the Council of The Corporation of the Town of
Kincardine has enacted By-law 4350, a zoning by-law enacted under
Section 34 of the said planning Act;
AND WHEREAS the Council of The Corporation of the Town of
Kincardine desires to amend such by-law;
NOW THEREFORE the Council of The Corporation of the Town of
Kincardine ENACTS as follows:

By-law No. 4350, as amended, being
by-law for The Corporation of the
hereby further amended by adding
12.38 to Section 12 thereof:

the following Subsection
12.38
Notwithstanding their 'R2' zoning designation,
those lands described as Part of Park Lots 7 and
8, plan 4, South Side of King Street, being Parts
1 to 5 of Reference Plan 3R-2388, delineated as
'R2-1' on Schedule WA" to this by-law may be used
for the purposes of a group home for the mentally
handicapped, operated by the Kincardine and
District Association for the Mentally Retarded, in
compliance with the 'R2' zone provisions contained
in this by-law excepting, however:
a) For the purposes of this Subsection, a "GROUP
HOMEw shall mean a pair of semi-detached dwellings
in which a total of three (3) to eight (8)
residents, excluding staff or host family, live
consistent with the requirements of its residents.
The Home shall be licensed under provincial
Statute and be in compliance with municipal by-
laws.
b) The off-street parking requirements of Section
4.12 shall apply excepting however that there will
be a minimum of four (4) parking spaces.

Schedule wAw to By-law No. 4350, as amended, is hereby
further amended by changing thereon from 'R2' (Residential-
Two Zone) to 'R2-1' (Residential Two Zone Special) the
zoning designation of Part of Park Lots 7 and 8, Plan 4,
South Side of King Street, being parts 1 to 5 of Reference
plan 3R-2388, Town of Kincardine, which are shown outlined
in the heaviest black broken line on the attached Schedule
"An.

This by-law takes effect from the date of
Council and comes into force pursuant to the
the Planning Act, S.O., 1983, Chapter 1.
