A BY-LAW TO AMEND BY-LAW NO. 4350, AS AMENDED, IN ORDER TO REZONE 644 VICTORIA STREET TO R3-1-1 WHEREAS Section authorizes the zoning by-laws; 34 of The councils Planning Act, S.O. of municipalities 1983, Chapter 1 to enact and amend AND WHEREAS the Council of The corporation of Kincardine has enacted By-law 4350, a zoning by-law Section 34 of the said Planning Act; the Town of enacted under AND WHEREAS the Council of The corporation of the Town of Kincardine desires to amend such by-law; NOW THEREFORE the Council of the The Corporation of the Town of Kincardine ENACTS as follows: 1. By-law No. 4350, as amended, being the comprehensive zoning by-law to The Corporation of the Town of Kincardine, is hereby further amended by adding the fOllowing subsection 12.40 to Section 12 thereof: 12.40 Nothwithstanding their 'R3-l' zoning designation, those lands described as Lots 26 and 27, west side of Victoria Street, plan No. 61, in the Town of Kincardine, and identified by the zone symbol 'R3- 1-1' on Schedule "A" of this by-law shall only be used for those uses permitted in the 'R3-l' zone in compliance with the 'R3-l' zone provisions contained in this by-law, excepting however that: i) the minimum front yard for an existing building may be 2.1 metres. 2. Schedule "A" of By-law 4350, as amended, being the comprehensive zoning by-law of The Corporation of the Town of Kincardine, is hereby further amended by changing thereon from "R3-l" and "OS" to "R3-1-1" the zoning designation of those lands described as Lots 26 and 27, west side of Victoria street, Plan No. 61, in the Town of Kincardine, and which are shown outlined by the heaviest black broken line on the Schedule "A" of this by-law. 3. This by-law takes effect and comes into force planning Act, S.O. 1983, from the date pursuant to Chapter 1. of passage by Council the provisions of The READ a FIRST and SECOND TIME this 21st day of May, 1987.
