PRYDE C/O PRYDE SCHROPP MCCO PART LOTS 49 AND 50, CONCESSION' , MUNICIPALITY OF KINCARDINE (FORMER TOWNSHIP F KINCARDINE) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapte 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipali of Kincardine has enacted By-law 2003-25, a zoning by-law enacted under Secti n 34 of the said Planning Act; , AND WHEREAS the Corporation of the Municipality of Kincardine dLsires to amend By- law 2003-25; r ! NOW THEREFORE the Council of the Corporation of the Municiþality of Kincardine ENACTS as follows: 1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby f rther amended by changing thereon from 'PO' to 'R1-0' and from 'EP' to 'EP-e' t e zoning designation of those lands described as Part Lots 49 and 50, Concession 'A', Municipality of Kincardine (former Township of Kincardine) w ich are outlined on the attached Schedule 'A'. 2. By-Law No. 2003-25 as amended, is hereby further amende by adding the following paragraphs to subsection 12.3 thereof: 12.3.15 Notwithstanding their 'R1' Zoning designation, t ose lands described as Part Lots 49 and 50, Concessio 'A', Municipality of Kincardine (former Township of Kincardine), a d delineated as 'R1- 0' on Schedule 'A' to this By-law may be us in compliance with the 'R1' Zone provisions contained in thi By-law, excepting however, that: (i) The minimum lot frontage shall be no I ss than 21.6 metres (70.9 feet). 3. By-Law No. 2003-25 as amended, is hereby further amend by adding the following paragraphs to subsection 34.6 thereof: 34.6.5 Notwithstanding their 'EP' Zoning designation, hose lands described as Part Lots 49 and 50, Concessio 'A', Municipality of Kincardine (former Township of Kincardine), a d delineated as 'EP- e' on Schedule 'A' to this By-law may be us in compliance with the 'EP' Zone pròvisions contained in thi By-law, excepting however, that: . . ./2 e e e - By-law No. 2003 -167 BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 20Q3-25, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE MUNICIPALITY! OF KINCARDINE SUSAN K. PRYDE C/O PRYDE SCHROPP MCCqMB, INC., PART LOTS 49 AND 50, CONCESSION '.f\', MUNICIPALITY OF KINCARDINE (FORMER TOWNSHIP pF KINCARDINE) (i) site alteration, regrading, filling or excav~tion is not permitted in the EP zone, except for the work~ involved with the installation of approved stormwater! management and watermain infrastructure; (ii) trees shall not be removed in the EP zope, except for proper forest management practices, safety I reasons, approved municipal shared-use trails, works I involved with the installation of approved stormwater I management and watermain infrastructure, and as apþroved in the tree retention plan. . 4. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Açt, R.S.O. 1990. This By-law may be cited as the "Amendment to Compreher1sive Zoning By-law 2003-25, (Part Lots 49 and 50, Concession 'A', Municipality 9f Kincardine [former Township of Kincardine]), By-Law.
