THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 1987-107 BEING A BY-LAW TO CONTROL WASTE PURSUANT TO SECTION 210 OF CHAPTER 302, AS AMENDED DISCHARGES TO MUNICIPAL SEWERS THE MUNICIPAL ACT, R.S.O. 1980, NOW THEREFORE the Council of The Corporation of the' Town of Kincardine ENACTS as follows: SECTION 1 DEFINITIONS In this by-law (al "biochemical oxygen demand" means the quantity of oxygen utilized in the biochemical oxidation of matter in five (5) days at twenty (201 degrees celsius; (bl "combined sewer" means a sewer intended to function simultaneously as a storm sewer and a sanitary sewer; (c) "matter" includes any solid, 1 iquid or gas; (d) "Municipality" means the Corporation Kincardine; of the Town of (e) "pH" means the logarithm to the base 10 the concentration of hydrogen ions in solution; of the reciprocal of grams per litre of (f) "phenolic compounds" means those derivatives of aromatic hydrocarbons which have a hydroxyl group directly attached to the ring; (g) "sanitary sewer" means a sewer for the collection and transmission of domestic, commercial and industrial sewage or any of one or combination thereof; (h) "sewage" means any liquid waste containing animal, vegetable or mineral matter in solution or in suspension, except uncontaminated water; ( i I "sewage works" means transmission, treatment of such works; any works for the or disposal of sewage, collection, or any part (jl "Standard Methods" means a procedure set out in "Standard Methods" for the Examination of Water and Wastewater" published jointly by the American Public Health Association, American Water Works Association and Water pollution Control Federation, current at the date of testing, or a procedure approved by an analyst of the Ministry of the Environment; (k) "storm water" means water from rainfall or other natural precipitation or from the melting of snow or ice; (1) "storm sewer" means a sewer for the collection and transmission of uncontaminated water, storm water, drainage from land or from a watercourse or anyone or combination thereof; (ml . (nl 2 "suspended solids" means solid matter in or on a liquid which matter is removable by filtering; "uncontaminated water" means water been added as a consequence of its use, by any agent. to which no matter has use, or to modify its SECTION 2 DISCHARGES TO SANITARY SEWERS No person shall discharge or deposit or cause or permit the discharge or deposit into land drainage works, private branch drains or connections to any sanitary sewer, matter of any type or at any temperature or in any quantity which mayor may become harmful to a sewage works, or which may cause the sewage works effluent to violate discharge criteria, or which may cause sewage works sludge to violate Sludge Guidelines for the utilization of sludge on agricultural lands if this is the intended means of sludge disposal or which may interfere with the proper operation of a sewage works, or which may impair or interfere with any sewage treatment process, or which may be or may become a hazard to persons, animals or property, and, without limiting the generality of the foregoing, any of the following: (al Sewage that may cause an offensive odour to emanate from a sewage works, and without limiting the generality of the foregoing, sewage containing hydrogen sulphide, carbon disulphide, other reduced sulphur compounds, amines or ammonia; (excluding in-situ generation of these compounds due to decomposition/reduction of human wastes in sewagel. (bl Unless otherwise indicated, storm water, water from drainage of roofs or land, or from a watercourse, or uncontaminated water; except that which may be discharged into a combined sewer; (cl Sewage at a temperature greater than 65 degrees Celsius. (dl Sewage having a pH less than 6.0 or greater than 10.5; (el Explosive matter, gasoline, benzene, naptha, fuel oil, solvents or sewage containing any of these in any quantity; (fl Sewage containing more than 100 milligrams per litre of solvent extractable matter of animal, vegetable, mineral or synthetic origin; (gl (hI (i I . (j I Note: Sewage which consists of two or more separate liquid layers; Sewage in which the biochemical oxygen demand exceeds 300 milligrams per litre; sewage containing more than 350 milligrams per litre of suspended solids; Sewage containing any of the following the indicated concentrations; matter in excess of one of the matters on excess of its limit The presence in sewage of any this list in a concentration in constitutes a separate offence. 3 . 500 mg/li tre Chlorides expressed as Cl- Sulphates expressed as S04 50 mg/litre Aluminum expressed as Al Iron expressed as Fe 10 mg/litre Fluorides expressed as F- Phosphorus expressed as P 5 mg/litre Antimony expressed as Sb Bismuth expressed as Bi Chromium expressed as Cr Cobalt expressed as Co Lead expressed as pb Manganese expressed as Mn Molybdenum expressed as Mo Selenium expressed as Se Silver expressed as Ag Tin expressed as Sn Titanium expressed as Ti Vanadium expressed as V 2 mg/litre Copper expressed as Cu Cyanide expressed as HCN Nickel expressed as Ni Zinc expressed as Zn 1 mg/litre Arsenic expressed as As Cadmium expressed as Cd phenolic Compounds No Discharge Waste Mercury Waste Radioactive Materials Waste pathogenic Materials Wastes Containing known Human Carcinogens except as Permitted by the By-law Waste pesticides/Herbicides Hazardous industrial wastes and chemicals (as defined in Schedules 1-3 of O. Reg. 309) . Dilution to achieve any limits expressed in this bylaw is prohibited. . . 4 SECTION 3 DISCHARGES TO STORM SEWERS No person shall discharge or deposit or cause or permit the discharge or deposit into land drainage works, private branch drains or connections to any storm sewer, matter of any type or at any temperature or in any quantity which may interfere with the proper operation of a storm sewer, or which may obstruct a storm sewer or the flow therein, or which may be or may become a hazard to persons, animals or property, or which may impair the quality of the water in any well, lake, river, pond, spring, stream, reservoir or other water or watercourse and without limiting the generality of the foregoing any of the following: (a) Uncontaminated water at a temperature greater than 65 degrees Celsius; (bl Sewage at a temperature greater than 65 degrees Celsius; (c) Sewage having a pH less than 6.0 or greater than 9.5 or which due to its nature or content becomes less than 6.0 or greater than 9.5 within a sewage works; (dl Explosive matter, gasoline, benzene, naptha, fuel oil, solvents, or sewage containing any of these in any quantity; (e) Sewage containing more than 15 milligrams per litre of solvent extractable matter; (f) Sewage which consists of two or more separate liquid layers; (g) Sewage containing coloured matter, which sewage would require a dilution in excess of four (4) parts of distilled water to one (11 part of such sewage to produce a mixture the colour of which is not distinguishable from that of distilled water; (hI Sewage of which the biochemical oxygen demand exceeds 5 milligrams per litre; (i) Sewage containing any matter which will not pass through a screen having openings not larger than 3.35 millimetres square (No.6 standard sievel; (j) Sewage that may cause an offensive odour to emanate from a sewage works, and without limiting the generality of the foregoing, sewage containing hydrogen sulphide, carbon disulphide, other reduced sulphur compounds, amines or ammonia; (kl Sewage containing any of the following matter in excess of the indicated concentrations; 5 Note: The presence in sewage of any this list in a concentration constitutes a separate offence. one of the matters on in excess of its limit . 15 mg/li tre Suspended Sol ids 10 mg/li tre Ammonia expressed as N 2 mg/litre Fluorides expressed as F 1 mg/litre Aluminum expressed as Al Arsenic expressed as As Chlorine expressed as C12 Chromium expressed as Cr Copper expressed as Cu Iron expressed as Fe Lead expressed as Pb Manganese expressed as Mn Nickel expressed as Ni Phosphorus expressed as P Tin expressed as Sn zinc expressed as Zn .1 mg/litre Barium expressed as Ba Cadmium expressed as Cd Cyanide expressed as HCN .02 mg/litre Phenolic Compounds .001 mg/litre Mercury expressed as Hg Dilution to achieve any limits expressed in this bylaw is prohibited. (1) Storm water runoff from commercial, industrial, and institutional properties shall be limited to a maximum of 70 litres/second/hectare. (m) Sanitary sewage shall not be directed to a storm sewer. . SECTION 4 AGREEMENTS A person who has entered into an agreement with the Municipality with respect to the discharge or deposit of sewage shall not be prosecuted under Section 2 of this by-law for the discharge or deposit of sewage in accordance with the terms of that agreement. 6 SECTION 5 . PROGRAM APPROVAL A program approval complying effluent construction and/or may be issued for the during the period of installation of treatment discharge of a non- planning, design, facilities. (a) The owner or occupant of commercial, institutional or industrial premises may submit to the municipality a program to prevent or to reduce and control the discharge or deposit of sewage or uncontaminated water into connections to a sewage works or to a storm sewer from those premises. (b) The municipality may issue an approval to be known as a "program approval" to the person who submitted the program. (c) A person to whom a program approval has been issued shall not be prosecuted under Section 2 or 3 of this by-law for the discharge or deposit of sewage during the period within which the program approval is applicable provided that the person complies fully with the terms of the program approval. SECTION 6 GENERAL CONSIDERATIONS 1. Except as otherwise specifically provided in this by-law, all tests, measurements, analyses and examinations of sewage, its characteristics or contents shall be carried out in accordance with Standard Methods; Note that the definition of Standard Methods includes a method approved by an analyst of the Ministry of the Environment. 2. (a) The Owner or occupant of commercial, institutional or industrial premises with one or more connections to a sewage works shall install and maintain in good repair in each connection a suitable manhole to allow observation, sampling and measurement of the flow of sewage therein, provided that where installation of a manhole is not possible, an alternative device or facility may be substituted with the approval of the Municipality. (b) Every manhole, device or facility installed as required by (a) (abovel of this by-law shall be designed and constructed in accordance with good engineering practice and the requirements of the municipality, and shall be constructed and maintained on the lands of the owner or occupant of the premises at his expense; . (c) The owner or occupant of commercial, institutional or industrial premises shall at all times ensure that every manhole, device or facility installed as required by (a) (above) of this by-law is at all times accessible for purposes of observing, sampling and measuring the flow of sewage therein; (d) The municipality may require the owner or occupant of commercial, institutional or industrial premises to install devices to monitor sewage discharges and to submit regular reports regarding the discharges to the municipality. (e) Should the development be of a nature where the above requirements are considered to be onerous, the municipality may waive or amend the above requirements in a development agreement. . . 7 3. For the purpose of the administration of this by-law, an agent of the Municipality may, upon production of his identification, enter any commercial, institutional or industrial premises, to observe, measure and sample the flow of sewage to any sewer. 4. No person shall break, damage, destroy, deface or tamper with: (a) Any part of a sewage works; (b) Any device whether permanently in a sewage works for the sampling and testing of sewage. or temporarily installed purpose of measuring, 5. Every person who contravenes any provision of this by-law is guilty of an offence and on summary conviction is liable to a fine of not more than $ 2,000. for every day or part thereof upon which such offence occurs or continue. 6. By-law No. 2087 passed on the 5th day of September, 1969 be and the same-rs-hereby repealed. 7. By-law No. 4757, passed on the 21st day of August, 1986 be and the same is hereby repealed.
