BY-LAW NO. 1988-4
A BY-LAW TO EXECUTE AN ENCROACHMENT AGREEMENT FOR PART
OF LOT 6 IN THE SUBDIVISION OF LOT 11 ON THE NORTH SIDE
OF LAMBTON STREET, PLAN 61 IN THE TOWN OF KINCARDINE
WHEREAS Kenneth Richard Davies has
the Town of Kincardine to execute
encroachment of a building onto the
allowances;
requested The Corporation of
an agreement concerning the
Lambton and Queen Street road
AND WHEREAS the Council for The Corporation of the Town of
Kincardine deems it expedient to execute this agreement;
NOW THEREFORE the Council for The corporation of the Town of
Kincardine ENACTS as follows:
1. The mayor and clerk are hereby authorized to execute, on
behalf of The Corporation of the Town of Kincardine, the
agreement with Kenneth Richard Davies concerning a building
located on Part of Lot 6 in the subdivision of Lot 11, Plan
61 being more particularly described in Schedule "A"
attached which encroaches upon the Queen and Lambton Street
road allowances.
2. This by-law shall come into full force and effect upon the
date of its final passage.
READ a FIRST and SECOND time this 4th day of February, 1988.

THIS AGREEMENT made this 4th day of February, 1988,

THE CORPORATION OF THE TOWN OF
KINCARDINE,
Hereinafter called nThe Corporation"
OF THE FIRST PART
- AND -
KENNETH RICHARD DAVIES,
Hereinafter called "The Licensee"
OF THE SECOND PART
WHEREAS The Licensee is the owner of the lands more
particularly described in Schedule "An attached hereto;
AND WHEREAS there has been erected on the said lands for
many years a two-storey brick building which encroaches onto the
Queen Street road allowance by a maximum of Ø.22 feet and onto
Lambton Street road allowance by a maximum of 1.18 feet, the
encroachment being further shown on the survey attached hereto as
Schedule "Bn;
AND WHEREAS The Licensee has requested permission from The
Corporation to maintain the said encroachment in its present
position;
NOW THEREFORE THIS AGREEMENT WITNESSETH that in
consideration of the mutual covenants and agreements hereinafter
contained and the sum of ONE DOLLAR ($l.ØØ) now paid by The
Corporation (the receipt whereof is hereby by it acknowledged),
the parties hereto agree as follows:
1. The Corporation hereby grants to The Licensee permission to
maintain the said encroachment.
2. The Licensee covenants that he shall indemnify and save
harmless The Corporation from and against all loss or damage
arising from the negligence of The Licensee and from and agains
permission hereby granted to maintain the said encroachment.

improving or maintaining the said Queen Street and the said
Lambton Street, then The Licensee shall cause the said
encroachment to be removed a t his own expense wi thin two mon ths
frm the date that The Corporation so notifies him in writing.
The Corporation undertakes that such action shall be undertaken
only where no reasonable alternative exists.
4. Unless renewed by the parties, this Agreement shall
terminate upon the earlier of the following:
(i) the 4th day of February, 2ØØ8; or
(ii) the substantial destruction of the said two-storey
brick building so as to require re-building.
5. This Agreement shall enure to the benefit of and be binding
upon, the said parties hereto, their heirs, executors,
administrators, successors and assigns, respectively.
IN WITNESS WHEREOF The Corporation hereto affixed its
corporate seal attested by the hands of its duly authorized
officers this 18th day of February, 1988, and The
Licensee has hereunto set his hand and seal this ì+' day of

ALL AND SINGULAR 'that certain parcel or tract of land and premises,
si tuate, lying and being in the Town of Kincardine, in the County-
of Bruce and Province of Ontario and being composed of part of Lot
6 in the subdivision of Lot Number lIon the North side of Lambton
_s reet according to Plan Number 61 for the Town of Kincardine, in
County of Bruce, more particularly described as follows:
ENCING at the Southwest angle of said Lot Number 6;

THENCE Easterly along the Southerly limit of said Lot 6, 40.0 feet;
THENCE Northerly parallel to the Westerly limit of said Lot 6, a
distance of 24.0 feet;
'I'IIENCE Westerly parallel to the Southerly limit of said Lot 6, a
distance of 40.0 feet more or less to the Westerly limit of· said
Lot 6;
THENCE Southerly along the westerly limit of said Lot 6, 24.0 feet
more or less to the point of Commencement.
