BY-LAW NO. 1988-9
BEING A BY-LAW TO ENTER INTO AN AGREEMENT TO AMEND THE
EMPLOYMENT CONTRACT WITH THE ECONOMIC DEVELOPMENT
COMMISSIONER FOR THE TOWN OF KINCARDINE
WHEREAS The Corporation of the Town of Kincardine
expedient to amend the employment contract date for the

NOW THEREFORE, The corporation of the Town of Kincardine ENACTS
as follows:
1. The mayor and clerk are hereby authorized, on behalf of The
corporation of the Town of Kincardine, to sign an agreement
to amend the employment contract of J. Brian Radigan,
Economic Development Commissioner for the Town of Kincardine
in order to terminate his employment on December 31, 1987
and not on January 3, 1988 as set out therein.
READ a FIRST and SECOND time this 18th day of February, 1988.

BETWEEN:
THE CORPORATION OF THE TOWN
OF KINCARDINE
(Hereinafter called the "Town")
- and -
JOHN BRIAN RADIGAN
WHEREAS the Town and John Brian Radigan entered into a
contract dated January 3, 1985 for the employment of the said
John Brian Radigan for a three year period ending January 3, 1988,
a copy of which is attached hereto as appendix "A" to this
Agreement.
AND WHEREAS John Brian Radigan has requested that the
said employment contract be amended in order to terminate his
employment on December 31, 1987 rather than on January 3, 1988.
AND WHEREAS the Town has agreed to comply to,this reques
NOW THEREFORE WITNESSETH AS FOLLOWS:
1.
It is agreed between the parties that the employment
of John Brian Radigan pursuant to the Agreement
attached hereto as appendix "A" will terminate on
December 31, 1987 and not on January 3, 1988 as set
out therein.
IN WITNESS WHEREOF the Town has hereto affixed its
Corporate seal, attested by the hands of its duly authorized
officers on that behalf and John Brian Radigan has hereto set his
hand and seal.

WHEREAS the Town deems it expedient to employ an economic
development commissioner.

AND WHEREAS John Brian Radigan has been appointed to the
position of economic development commissioner pursuant to By-law
4644.

AND WHEREAS By-law 4644 provides that the appointment
to the position of economic development commissioner shall be
subject to an appointment between John Brian Radigan and the Town.

WITNESSETH AS FOLLOWS:

The Town hereby hires John Brian Radigan to be,the
economic development commissioner for the Town upon the following
terms and conditions and in accordance with By-law 4644 of the
Town, which John Brian Radigan hereby accepts, namely:
1. The term of employment will be for three years from the
,date hereof, subject to earlier termination as hereinafter
provided.

2.
The gross salary of John Brian Radigan for the first and
second years of employment shall be in accordance with By-law
4578, Schedule "C", grade scale "Q". For the second year of
employment, the gross salary of John Brian Radigan will not
be less than increment 4/5 of the aforementioned grade scale
"Q". The gross salary of John Brian Radigan for the third
year of employment shall be established by negotiations and in
any event there shall be no reduction in gross salary unless
otherwise agreed to by the Parties hereto., If a salary for
for the third year cannot be successfully negotiated, such
failure to reach agreement on a salary shall be grounds for
termination of this agreement.

3. John Brian Radigan shall devote his whole working time and
attention to the employment during the term thereof and shall
not engage in any other business or occupation during the term
of employment.
John Brian Radigan shall not, either during the term of his
employment or at any time thereafter, disclose to any person,
firm or corporation any information concerning the business
or affairs of the Town which John Brian Radigan may have
acquired in the course of or incidental to his employment
hereunder or otherwise, whether for his own benefit, or to
the detriment, or intended or probable detriment, of the
Town.

following benefits of employment shall apply:
Canada Pension Plan (employer share only);
Unemployment Insurance (employer share only);
Worker's Compensation coverage;
Enrollment in the Ontario Municipal Employee's
Retirement System;
Two weeks vacation for each full year of service;
Paid holidays as per Section 11, Schedule "A" of By-law
4265;
Compassionate leave as per Section 13, Schedule "A" of
By-law 4265;
Twenty-one (21) days of sick leave per annum at' 100 per
cent (100%) of salary. Unused sick leave may be
accumulated but there is no payment of unused sick leave
upon termination of employment.
i) Group insurance will apply. The Town will pay 50% of
the premium on the dental plan and 100% of the premium
on the rest of the plan. The group insurance plan shall
be the same as is available to the Town's full time
employees.

6.
The Town may terminate this agreement at any time with one
week's notice by reason of the employee's violation of
instructions or rules of the Town, or failure to comply with
any agreement on the part of John Brian Radigan as herein
set out. Any such action may only be taken after a hearing
by the councilor a committee of the whole council if requested
. ,
