HomeMy WebLinkAboutKIN 88 034 Pedi-Cab Bylaw THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 1988-34 BEING A BY-LAW TO PROVIDE FOR THE LICENSING OF OWNERS AND DRIVERS OF PEDI-CABS IN THE TOWN OF KINCARDINE . WHEREAS Section 227 of the Municipal Act, R.S.O., Chapter 302 provides that the councils of towns may pass by-laws for the licensing, regulating and governing of vehicles used for hire and for establishing the rates or fares to be charged by the owners or drivers of such vehicles; AND WHEREAS the Council for The Corporation of the Town of Kincardine deems it expedient and desirable to enact a by-law regulating the owners and drivers of pedi-cabs in the Town of Kincardine; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. For the purposes of this by-law a pedi-cab shall be a non- motorized vehicle used for the transportation of not more than two people on a sight seeing basis only. 2. No person shall, whether as owner or driver, operate a pedi- cab for hire in the Town of Kincardine unless he shall have first obtained a license according to the privileges to do so in the current calendar year from the treasurer of the Town of Kincardine and no person shall drive a pedi-cab for hire for which an owners license under this by-law has not been issued for the current year. 3. The Owner of the pedi-cabs shall apply for such license in writing to the treasurer, setting forth all particulars with respect to each pedi-cab for which a license is sought and such application shall be on a form similar to the one attached as Schedule "A" to this by-law. Such application shall be delivered to the treasurer duly signed by the applicant and accompanied by the fee prescribed herein. 4. The license fee payable by the owner shall be $20.00 per year for each pedi-cab. 5. Application for a license to drive shall be made in writing to the treasurer and shall be in a form similar to the one attached as Schedule "B" to this by-law. Such application shall be delivered to the treasurer and shall be signed by the applicant and accompanied by the fee prescribed herein. 6. The 1 icense fee payable by a d river shall be the sum of $10.00. 7. All drivers of pedi-cabs in the Town of Kincardine must be of at least eighteen years of age, have a driver's license and produce a letter of favourable recommendaton from the chief of police. 8. Before a license is granted to the Owner under this by-law, the applicant for such license shall procure a policy of insurance for each of his pedi-cabs to be licensed covering public liability, property damage and passenger hazard risk to at least the amount of $1,000,000. inclusive, for anyone accident; such policy of insurance shall be deposited and retained by the treasurer who nevertheless shall not, in any way, be responsible for seeing that such policy of insurance is kept in force. . . . The following rates and no other shall be charged for the use of pedi-cabs: 1/2 hour or less...................$ 15.00 Per hour...........................$ 25.00 1 day............................. .$100.00 10. All pedi-cabs operated within the Town of Kincardine must be kept in a state of good repair in order not to present a potential damage to any passengers. 11. The operation of pedi-cabs shall be restricted to the following hours (daily): June & September - 8:00 a.m. - 10:00 p.m. July & August - 7:00 a.m. - 11:00 p.m. 12. Owners, operators and drivers of pedi-cabs shall be restricted to the picking up and drop off of passengers to the locations outlined on Schedule ·c· to this By-law. 13. Owners, operators and drivers of pedi-cabs shall not drop off or pick up passengers at any point other than the original pick-up location, with the exception of rentals under No. 4 of Schedule "C· of this By-law. 14. Any person that contravenes any of the provisions of this by-law shall upon conviction therefore be subject to a penalty of not more than $1,000.00 exclusive of costs and every such penalty shall be recoverable under the Provincial Offences Act. 15. This by-law shall be known as the ·Pedi-Cab By-law". 16. This by-law shall come into full force and effect upon the final passing thereof. READ a FIRST and SECOND time this 21st day of April, 1988.
