that councils of municipalities may pass by-laws to
regulate and govern vehicles from which refreshments are
pUblic consumption of the public;
AND WBBRBAS it is deemed expedient and desirable to enact such a
by-law'
NOW TBBRBPORB the Council of The Corporation of the Town of
Kincardine BRACTS as follows:
1. For the purposes of this By-law -bicycle- means and includes
bicycle, tricycle or motorcycle.
2. No person shall sell frozen refreshments for the consumption
by the public from a bicycle without a license for this
purpose issued by the council.
3. The annual fee for a license under this By-law shall be
$20.00 per vehicle.
4. Every license under this By-law shall be for one year and,
unless sooner revoked, shall expire on the 31st day of
December next following the date of its issue.
5. A health inspector for the County of Bruce shall inspect
every such bicycle prior to a license being issued and every
person to whom a license has been granted shall comply with
the requirements of said health inspector.
6. Before a license is granted under this by-law, the applicant
for such license shall procure a policy of insurance on each
of his bicycles to be licensed covering public liability and
property damage to at least the amount of one million
dollars ($1,000,000.), inclusive, for anyone accident; such
policy of insurance to be deposited with and retained by the
Town's treasurer, who nevertheless shall not in any way, be
responsible for seeing that such policy of insurance is kept
in force.
7.
Any person that contravenes any of the provisions of this
By-law shall upon conviction therefore be subject to a
penalty of not more than $1,000., exclusive of costs, and
every such penalty shall be recoverable under the Provincial
Offenses Act.

8.
This By-law shall be known as the -refreshment bicycle by-
law.-
9. This By-law shall come into full force and effect upon the
date of its final passing thereof.
READ a FIRST and SECOND time this 21st day of April, 1988.
READ a THIRD time and FINALLY PASSED this 3rd day of May, 1988.
