WHBRBAS Section 298 (1) of the Municipal Act, R.S.O.
Chapter 302, as amended, permits the council of
municipality to pass by-laws for stopping up, closing and
highways;

ARD WHBRBAS it is deemed expedient in the interest of The
Corporation of the Town of Kincardine, hereinafter referred to as
the "Corporation·, that the road allowance set out and described
in Schedule "A" attached hereto be closed and stopped up and the
land sold;
MID WHEREAS notice of this by-law has been published once a week
for four consecutive weeks in the Kincardine News, a newspaper
published in the Town of Kincardine;
ARD WHBRBAS the Council of the said Corporation has heard in
person or by its counsel, solicitor or agent, all persons
claiming that their land will be prejudicially affected by this
by-law and who applied to be heard;
HOW THBREPORE, the Council for The Corporation of the Town of
Kincardine BRAC'l'S as follows:
1. The Council of The Corporation of the Town of Kincardine
does hereby stop up and close to vehicular traffic, that
part of the municipal road allowance lying and being more
particularly described in Schedule "A" attached.
2. Council authorizes the sale of the road allowance described
in Schedule "A" to the adjoining owner and fixes the price
at which the road allowance is to be sold at $1.00 and fixes
the period within which the abutting owner shall have the
right to purchase that part of the said road allowance upon
wh ich h is/her land abuts to be the per iod from the date of
passage of this by-law to the 1st day of June, 1988.
3. If the adjoining owner exercises his/her right to purchase
the lands described in schedule "A" within the period set
out in paragraph 2 of this by-law, Council authorizes the
sale of the lands described in Schedule ·A" to Ronald
Boucher on the terms and conditions as set out in an
Agreement of Purchase and Sale attached hereto as Schedule
"B".
4. The mayor and clerk are hereby authorized to execute all
documentation in connection with the closing and sale of the
said lands.
5.
There shall be attached to this by-law as Schedule "CO, the
affidavit of Ronald R. Shaw, Clerk of The Corporation of the
Town of Kincardine, setting out the procedures taken for
publishing and posting of the said notices pursuant to the
provisions of the Municipal Act.

6. The Clerk of The Corporation of the Town of Kincardine is
hereby authorized and instructed to register a copy of this
by-law in the Registry Office of Bruce (NO.3) in Walkerton,
Ontario.

by-law.

NOTICE is hereby given pursuanllo Saction 301 of The Municipal ACI, A.S.O. 1980,
Chapter 302 that th~ Council of The Corporation of the Town Of Kincardine proposes to
pass a by-law to SlOp up, close and sell pan of the Park Street road allowance located south
01 Wellington Street and north of Scott Street. The parcel in question is approximately 33
feet by 50 feet consisting of an area of approximately 1,650 square teet.
Tha proposed pian, by-law and da.criplion showing Ihe lands affecled may be viewed
in the clwk's office at the Town Hall. 707 Queen Street. Kincardine. Ontario.
On Thursday, May 19,1988 a17:30 p.m. in the Countil Chambers, Town Hall. 707 Queen
Street, Kincardine, the Council of The Corporation of the Town of Kincardine will hear, in
person, or by counsel, solicitor or agent. any person who claims his or her land will be pre-

l. ,The Purchaser agrees to reimburse the Vendor for the costs of publishing
not1ce of the proposed by-law to sell the real property pursuant to Section 301
of the Municipal Act, R.S.O. 1980, Chapter 302. The Purchaser's solicitor shall
prepare the deed and by-law at the Purchaser's expense and the Purchaser shall
pay the reasonable legal costs in connection with the road closing. This Offer
shall be conditional upon the passage of the necessary by-law and in accordance
with the provisions of the Municipal Act, failing which this Offer shall become
null and void and the Purchaser's deposit shall be returned to him in full
without interest or deduction.
2. The parties hereto acknowledge and agree that Schedule "A" hereto shall
form a Dart of this Aareement.

THIS IS SCHEDULE "A" TO AN AGREEMENT OF PURCHASE AND SALE
BETWEEN RONALD BOUCHER, AS PURCHASER, AND THE CORPORATION
OF THE TOWN OF KINCARDINE, AS VENDOR.
The parties have agreed as follows:
1. The Purchaser shall pay all survey and legal costs involved
in arranging to transfer this land to him, in addition
to the costs hereinbefore set out.
2. The Purchaser will provide an easement in registerable
form to the Public Utilities Commission of the Town of
Kincardine in terms satisfactory to the Commission for the
purpose of maintaining a hydro corridor across the subject
parcel. The Purchaser will also pay the Vendor's legal
and survey costs with respect to the establishment and
registration of this easement.
The Purchaser will provide an easement in registerable
form in terms satisfactory to the Town allowing continued
municipal vehicle and pedestrian access across the subject
ands and access as required by the Town, from time to
time¡ for municipal purposes such as installation and
[lIaintenance of services.
4. The deed shall contain a provision by which the property
shall automatically revert to the Transferor in the event
that the owner of the fee in Lot 23, plan M-35, Town of
~incardine, County of Bruce, and the owner of the fee in
l.ot B, West side of Park Street, Town of Kincardine, County
~___ of_JI..r~.c_e shall cease to be one and the same.

Provided that this Agreement shall be eWtctive only if the provisions of Section 49 of the Planning Act, as amended, are complied with.
