HomeMy WebLinkAbout03 149 zoning kinfarm 82-08 - Jo. ~ THE CORPORATION OF THE MUNICIPALITY OF KINC INE e NO. 2003 - 149 e BEING A BY-LAW TO AMEND ZONING BY-LAW ~O. 82-08, BEING THE ZONING BY-LAW FOR THE TOWNSHIP qF KINCARDINE KINFARM TIRE LTD. ¡ PART LOT 50, CONCESSION 1 NDR (BEING PART 1 ON RP 3R~688 AND PART 1 ON RP 3R-5696; AND PARTS 1 AND 3 ON RP 3R-1533), MU ICIPALlTY OF KINCARDINE (FORMER TOWNSHIP OF KINCAR INE) e WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt r 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws w ich comply with an approved official plan; , AND WHEREAS the Council of the Corporation of the Townshiþ of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Section 34 ff the said Planning Act; I ¡ AND WHEREAS the Corporation of the Township of Kincardine ha, restructured to now be a part of the Corporation of the Municipality of Kincardine; I I AND WHEREAS the Corporation of the Municipality of Kincardine 1esires to amend By- law 82-08; I NOW THEREFORE the Council of the Corporation of the Muni1iPality of Kincardine ENACTS as follows: i 1. Schedule 'A' to By-law No. 82-08 as amended, is hereby furt er amended by zoning those lands described as Part Lot 50, Concession 1 DR (being Part 1 on RP 3R-3688 and Part 1 on RP 3R-5696; and Parts 1 and 3 n RP 3R-1533), Municipality of Kincardine (former Township of Kincardine),' 1-6- Rural Industrial Special' as outlined on the attached Schedule 'A'. ¡ I By-law 82-08, as amended, is hereby further amended by adding the following subsection to Section 25.4 thereof: I i Notwithstanding their 'M1' zoning designation'r,ands designated as 'M1-6 - Rural Industrial Special' on Schedul 'A' to this By-law, may be used in compliance with the 'M1' zone provisions contained in this by-law, excepting however, that: ! 2. 25.4.6 (i) (ii) e (iii) (iv) (v) The minimum lot area shall be 1457 s uare metres (15,682 square feet); and The minimum rear yard setback shall b 3 metres (10 feet); and The maximum lot coverage shall be 30· ; No part of any industrial building shall b located closer than 9.4 metres (31 feet) to the residential zo e; and The lands shall be subject to Site Plan ontrol. . . ./2 ~- - ,- e e e e I By-Law No. 2003 - 149 ~' Amendment to Comprehensive Zoning By-law 82-08 Part Lot 50, Concession 1 NDR [b ing Part 1 on RP 3R-3688 and Part 1 on RP 3R-5696; and Parts 1 and 3 on RP 3R-1533]. This By-law may be cited as the "Amendment to Zoning By-I¡jIw 82-08, (Part Lot 50, Concession 1 NDR [being Part 1 on RP 3R-3688 and Pai11 on RP 3R-5696; and Parts 1 and 3 on RP 3R-1533], Municipality of Kincardine [former Township of Kincardine]), By-Law". 3.
