THE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW NO. 2003 - 148 BEING A BY-LAW TO AMEND ZONING BY-LAW N .2003-25, BEING THE ZONING BY-LAW FOR THE MUNICIPALITY F KINCARDINE , i KINFARM TIRE LTD. t: PART LOT 50, CONCESSION 1 NDR (BEING PART 1 ON RP 3R 688 AND PART 1 ON RP 3R-5696; AND PARTS 1 AND 3 ON RP 3R-1533), MU ICIPALlTY OF KINCARDINE (FORMER TOWNSHIP OF KINCAR INE) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt r 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws w ich comply with an approved official plan; AND WHEREAS the Council of the Corporation of the MuniciPaliL of Kincardine has enacted By-law 2003-25, a zoning by-law enacted under Sect1~n 34 of the said ~M~~ ~ AND WHEREAS the Corporation of the Municipality of Kincardine d sires to amend By- law 2003-25; NOW THEREFORE the Council of the Corporation of the Munic pality of Kincardine ENACTS as follows: I Schedule 'A' to By-law No. 2003-25 as amended, is hereby f rther amended by zoning those lands described as Part Lot 50, Concession 1 DR (being Part 1 on RP 3R-3688 and Part 1 on RP 3R-5696; and Parts 1 and 30 RP 3R-1533), Municipality of Kincardine (former Township of Kincardine),' 3-e - Hamlet Highway Commercial Special' as outlined on the attached S hedule 'A'. 3. By-law 2003-25, as amended, is hereby further amended by adding the following subsection to Section 19.3 thereof: 3. 19.3.5 Notwithstanding their 'C3' zoning designation, lands designated as 'C3-e - Hamlet Highway Commercial Special on Schedule 'A' to this By-law, may be used in compliance ith the 'C3' zone provisions contained in this by-law, excepting owever, that: 3. (i) The minimum lot area shall be 1457 s uare metres (15,682 square feet); and (ii) The minimum rear yard setback shall b 3 metres (10 feet); and (iii) The maximum lot coverage shall be 30° ; and (iv) The lands shall be subject to Site Plan ontrol.
