BY-LAW 1988-49

A BY-LAW TO REGULA'.rB THE USE OF IlURICIPAL
SIDEWALKS ON MUNICIPAL ROAD ALLOWANCES
IN THE TOWN OF KINCARDINE
WHEREAS Section 315 (1) of the Municipal Act, R.S.O., 1980,
Chapter 302, as amended, authorizes the council of all
municipalities to pass by-laws for prohibiting or regulating the
obstructing, encumbering, injuring or fouling of highways or
bridges;
AND WRRv~a~ Section 298(1) (e) of the Municipal Act, R.S.O., 1980,
Chapter 302, as amended, author izes the council of every
municipality to pass by-laws for setting apart and laying out
such parts as may be considered expedient of any highway for the
purpose of carriage ways, boulevards and sidewalks, and for
beautifying the same, and making regulations for their
protection;
AND WHEREAS the Council of The Corporation of the Town of
Kincardine wishes to regulate the use of sidewalks in the Town of
Kincardine;
ROW THEREFORE the Council of The Corporation of the Town of
Kincardine BRACTS as follows:
1. In this by-law:
a) -place of Business· shall mean the premises where a
business is carried on.
b) -Merchant- shall mean a person who, in the ordinary
course of his business,
i) sells tangible personal property
ii) sells or tenders a service, or
iii) operates a place of amusement
2. No merchant shall place any goods, merchandise or other
materials on any road allowance in Town except in accordance
with the following:
a) Merchants may display merchandise from their place of
business on the road allowance immediately in front of
their place of business provided that the merchandise
is:
.
i) restr icted to 76cm (30 in.) from the edge of the
property line;
ii) immediately in front of their place of business;
and
iii) on the Queen Street road allowance from Durham
Market North to Durham Street or on the Lambton
Street road allowance from Huron Terrace to
Princes Street.
iv) Such merchandise will only be displayed during
normal business hours and will not be displayed
when the plows are in operation.
3. Any person contravening any provision of this by-law shall
be guilty of an offence and shall be liable upon conviction
to a penalty not exceeding One Thousand ($1,000.00) dollars
exclusive of costs, under the Provincial Offenses Act.

4.
Where applicable in this by-law, reference to the singular
shall include the plural and reference to the masculine
shall include the feminine.
5.
This by-law and any amendments thereto shall be known as the
·SIDEWALK DISPLAY BY-LAW·.
6. This by-law shall come into full force and effect upon the
date of its final passage.
