HomeMy WebLinkAboutKIN 88 068 Elderly Tax Credit THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW NO. 1988-68 BEING A BY-LAW TO ALLOW A UNIFORM TAX CREDIT TO OWNERS OF REAL PROPERTY IN THE TOWN OF KINCARDINE '. WHEREAS the Municipal Elderly Residents' Assistance Act, R.S.O. 1980, Chapter 307 as amended, provides that municipal councils may pass by-laws authorizing and directing the treasurer of the municipality to allow owners of residential real property in the municipality a uniform credit in an amount to be determined by the council of the municipality, against the real property taxeS imposed by the municipality in respect of such real property; AND WHEREAS the Council of The Corporation of the Town of Kincardine deems it advisable to enact such a by-law; NOW THEREFORE the Council of The Corporation of the Town of Kincardine hereby ENACTS as follows: 1. The treasurer shall allow owners of residential real property in the Town of Kincardine a credit in the amount of One Hundred Dollars ($100.00) per year against the real property taxes imposed by the Town of Kincardine in respect of such real property provided that, (a) such owner or the spouse of such owner or both has or have attained the age of sixty-five years by December 31st of the year the credit is allowed; (b) Such owner or the spouse of such owner or both occupies or occupy the property in respect of which real property taxes are imposed as his, her or their personal residence; (c) such owner or the spouse of such owner or both has or have been assessed as the owner of residential real property in the municipality for a period of not less than one year preceding the date of application for the credit; (d) no such credit shall be allowed to an owner in respect of more residential real property than one single family dwelling unit in any year; and ~ ~.~ 'j.ß-V"", , ~. (e) no owner who otherwise qualifies under subsection l.(a) to (d) shall receive a credit unless such owner or the spouse of such owner or both is or are receiving a monthly guaranteed income supplement under Part II of the Old Age security Act (Canada), 1973, c. 154, s.2. 2. The tax credit shall be paid in December annually, by cheque, to the property owner after the property owner has completed the appropriate application (Schedule "An to this by-law) and has satisfied the requirements of this by-law. 3. If the applicant owes any taxes to The Corporation of the Town of Kincardine, in respect to the real property of the owne r as his or he r or their res idence, the refund shall first be paid against the outstanding real property taxes and the balance, if any, shall be paid to the applicant in accordance with section 2 above. . 4. The onus is on the owner to apply for this tax credit. The treasurer shall advertise the tax credit information in the local papers each year in November for two consecutive weeks. Any tax credit not applied for in any year shall not be cumulative and shall not be collectible in any successive year. . . page 2 1988-68 This by-law shall come into full force and effect upon the date of its final passage, and shall be considered in force to enable tax credits to qualified owner or owners of real property in the Town of Kincardine for the 1988 taxation year. 5. 6. The short title for this by-law shall be the Elderly Person Tax Credit by-law.
