ADOPT AIIEliIDIIBHT HO. 2 TO THB OFFICIAL PLAN BY-LAW
WBBRR~~ Section 17 of the Planning Act, S.O. 1983, Chapter One,
as amended, authorizes the councils of local municipalities to
adopt official plans;
ABD WBBRBAS the Council for The Corporation of the Town of
Kincardine has adopted an Official Plan which was approved by the
Minister of Municipal Affairs on January 31, 1989;
AHD WHBREAS the recommendation has been made to the Council of
the Town of Kincardine that the Explanatory Text and Schedule RAR
constituting Amendment No. 2 to the Official Plan for the Town of
Kincardine, be adopted by the Council in accordance with the
provisions of the Planning Act, S.O. Chapter 1, 1983;
al - ~ this Council wishes to amend this Official Plan;
HOW THBRBFORB the Council for The Corporation of the Town of
Kincardine BRACTS as follows:
1. That Amendment No. 2 to the Official Plan for the Town of
Kincardine, a copy of which is attached hereto and forms
part of this by-law, is hereby adopted.
2. That the Clerk is hereby authorized and directed to make
application to the Minister of Municipal Affairs for the
approval of the aforementioned Amendment No. 2 to the
Official Plan for the Town of Kincardine.
3. This by-law shall come into full force and effect upon
approval by the Minister of Municipal Affairs.

PART A
THE PREAMABLE
PURPOSE
The purpose o~ this Amendment is to change the 'Residential'
policies to permit the enlargement o~ an existing building which
is presently utilized as a ~itness centre; the proposed addition
is to be used ~or the expansion o~ the dance studio and existing
accessory apartment.
LOCATION
The lands subject to this Amendment comprise Lots 5 and 6, West
side o~ Huron Terrace, Plan 4, in the Town o~ Kincardine.
BASIS
The most recent Town o~ Kincardine O~~icial Plan was adopted by
the Council o~ the Town o~ Kincardine on March 5, 1987 and was
subsequently approved, with modi~ications by the Minister o~
Municipal a~~airs on January 31, 1989.
The lands were subject to two Amendments to the ~ormer O~~icial
Plan o~ the Town o~ Kincardine, whioh has now been repealed. The
initial Amendment incorporated speoial 'Residential' polioies to
permit an existing building to be utilized as a ~itness centre;
the second Amendment was designed to permit the expansion o~ the
existing building to include a lounge and racquet sport
~aoilities. Both previous Amendments incorporated Site Plan
Control policies ~or the site and stated that should the non-
residential use oease, the range o~ permitted uses shall revert
to the normal uses o~ the 'Residential' designation.
At the time the most reoent O~~icial Plan was prepared, it was
not anticipated that the owner o~ the property would wish to
~urther expand the ~itness centre beyond the physical limits o~
the existing building (existing prior to the adoption and
approval o~ the present O~~icial Plan). Hence, the present
proposal is the result o~ an application on behal~ o~ the owner
o~ the property who wishes to expand the building to permit the
enlargement o~ the dance studio and accessory apartment.
It is intended that the Amendment will include policies relating
to Site Plan Control and the reversion o~ the property to a
residential use should the non-residential use cease.

PART B - THE AMENDMENT
INTRODUCTORY STATEMENT
All of this part of the Amendment entitled Part B - The Amendment
- consists of the following text and map constituting Amendment
No. 2 to the Official Plan of the Town of Kincardine.

DETAILS OF THE AMENDMENT
1.
The Official Plan of the Town of
amended by deleting Subsection D1.4.15
the following Subsection D1.4.15:
Kincardine is hereby
and replacing it with
D1.4.15 Notwithstanding the 'Residential' Land Use
Policies of this Plan, the following additional
uses shall be permitted within the existing
building situated on the lands described as Lots 5
,and 6, West side of Huron Terraoe, Plan 4, in the
Town of Kincardine:
a) a dance studio;
b) a health and fitness centre;
c) a lounge and racquet sports faoilities;
d) an accessory residential dwelling unit
forming an integral part of the existing
building and used only as the prinoipal
residenoe of the owner, manager or caretaker.
In addition to the foregoing uses, the expansion
and/or enlargement of the existing building may be
permitted for the expansion of the dance studio
and the expansion/relocation of the accessory
apartment. Any suoh expansion or enlargement
shall not ocoupy a greater area than 25% of the
combined area of Lots 5 and 6.
Any non-residential use permitted by this
Subseotion of the Plan will oome under the Site
Plan Controls of Section 40 of the Planning Act,
1983, as amended, or suoceeded, and the owner will
be required to enter into any neoessary agreements
with the Municipality.
Should the foregoing non-residential uses be
discontinued, the range of permitted uses shall
revert to those normally permitted in the
'Residential' designation and the municipal Zoning
By-Law shall be amended accordingly.

The Town of Kincardine has been circulated with a
request for comments concerning a minor variance
requested for Lot 56, west side Queen Street, Plan 61.
~he zoning change would affect lot area, lot width and
front yard.
Staff ColllllleDts: ~lhile the land is not severed, it is
zoned Industrial to the east side and residential on
the west side. Given the differences in zoning, the
severance and the necessary zoning amendment make
sense. Condi tions of the severance should be that a
survey be prepared indicating that the severed and
retained parcel meet the by-law and that the P.O.C. be
granted an easeaent over both parcels of land as shown
on Reference Plan 3R-3697 (attached).
Action: The committee will not object to the severance
given available information provided tbat the
conditions noted are imposed.
The Town has received a request for comment form for
R.J. Christopher (Fitne'ss Connection). The
Christopher's intend to enlarge the dance studio and
accessory apartment. Notice attached.
Staff coaaentS: This property actually has been
subject to two previous O.P. and Zoning amendments.
However, they do not cover this proposed expansion and
the amendments are necessary. Further, we recommend
that the app~icant prove they have sufficient parking
for the whole development. (RRS)
