BY-LAW NO. 1989-20

A BY-LAW TO PROHIBIT CERTAIN ANIMALS AND VEHICLES PROM
ENTERING AND OPERATING ON THE ATHLETIC PIELD AT THE
DAVIDSON CENTRE POR KINCARDINE . DISTRICT AND OTHER
PARKS IN THE TOWN OP KINCARDINE
WHEREAS subsection 208 (42) of the Municipal Act, R.S.O. 1980
Chapter 302 as amended allows the. cpuncils Qf all local
muntclpalltlds to passDy-~aws tor prohIbItIng carrIages, wagons,
bicycles, sleighs and other vehicles and conveyances of every
description, and whatever motive power, or any particular kind or
class of such vehicles or conveyances being upon, or being used,
drawn, hauled or propelled along or upon, any sidewalk, pathway
or footpath, used by or set apart for the use of pedestrians and
forming part of any highway or bridge, boulevard or other means
of public communication, or being in or upon any highway,
boulevard, park, park-lot, garden or other place set apart for
ornament or embellishment or for public recreation;
AND WHEREAS subsection 210 (4) of the Municipal Act, R.S.O. 1980,
Chapter 302, as amended, allows the councils of all local
municipalities to pass by-laws for prohibiting or regulating
within any part of the municipality or within any defined area
thereof, or upon any defined highways therein, the being at large
or trespassing of animals, other than dogs, and for providing for
impound ing of them and for causing them to be sold, if they are
not claimed within a reasonable time or if the damages, fines and
expenses are not paid according to law;
AND WHEREAS the Council for The Corporation of the Town of
Kincardine deems it advisable to prohibit all vehicles and horses
from entering and operating on the Athletic Field at the Davidson
Centre for Kincardine & District;
AND WHEREAS the Council for The Corporation of the Town of
Kincardine deems it advisable to prohibit most vehicles from
entering and operating in the Parks of the Town of Kincardine;
NOW THEREPORE the Council for The Corporation of the Town of
Kincardine ERACTS as follows:
1. That all horses, carriages (other than baby carriages),
wagons, bicycles, sleighs, motorcycles, snowmobiles, and
other vehicles and conveyances of every description, and
whatever the motive power, or any particular kind or class
of such vehicles or conveyances not owned or operated by the
Town of Kincardine or its authorized agents, are hereby
prohibited from entering or operating on any of the athletic
fields or running track at the Davidson Centre for
Kincardine and District at any time.
2. That all motorized vehicles of any description not owned and
operated by the Town of Kincardine or its authorized agents
are hereby prohibited from entering or operating in any park
designated as such by by-law of The Corporation of the Town
of Kincardine at any time and where signs indicating such
prohibition have been erected.

3.
Every person who contravenes any provision of this by-law
shall, upon conviction thereof, forfeit and pay a penalty
not exceding (exclusive of costs) the sum of two thousand
($2,000) dollars, for each such offence and every such
penalty shall be recoverable under the Provincial Offenses
Act, R.S.O. Chapter 400, as amended.

5.
If any provIsIon of this by-law is in conflict with other
previous by-laws, the provisions of this by-law shall
prevaiL
6.
This by-law shall come into full force and effect upon the
day of its final passage.
