THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW NO. 1989-72
BEING A BY-LAW TO SELL A PARCEL OF MUNICIPAL LAND
DESCRIBED AS PART LOT 22, PART LOT 21, EAST SIDE OF
PENETANGORE ROW, PLAN 61, TOWN OF KINCARDINE,
COUNTY OF BRUCE
WHEREAS The Kincardine Curling Club Limited has submitted an
Offer to Purchase for the land hereinafter described and more
particularly described in the Offer to Purchase attached hereto
as Schedule "A";
NOW THEREFORE, the Council for The Corporation of the Town of
Kincardine ENACTS as follows:
1. The mayor and clerk are hereby authorized to execute such
documents as they may deem adviseable to convey such lands
to the Kincardine Curling Club Limited as it may direct in
accordance with said Offer to Purchase attached as Schedule
"A".

3. That this by-law come into full force and effect upon the
date of its final passage.

~ . This offer is conditional for the Purchaser being able to hold a Board meeting before
closing date July 31, 1989, and at this said meeting, receiving a majority in favour of
this purchase. Failing which this offer shall become null and void and the Purchasers
deposit shall be returned to them in full without interest.
2. This offer is conditional upon the Council of The Corporation of the Town of Kincardine
passing a by-law to authorize the sale.
3. .on or before closing, the Vendor agrees to install sewer and water services to the
boundary of the subject property.
4. The Vendor shall pay the cost of a survey and the impost fees. It is understood that
no severance is required.
The Vador represents that as at the date of acceptance bereof the Vendor has not received from any municipal or other governmental
authority any deficiency notice or work order affectiDl the real property pursuant to which aoy deficiencies are required to be remedied or
any dem01itiOD~ repairs or replaœments are required to be carried out. If the Vendor receives any such deficiency notice or work order after
Ibe date of acceptance hereof, the Vendor shall forthwilb produce same to the Purchaser for inspection. If by Ibe date of closing Ihe Vendor has
not either (8) complied with such defkiency notice or work order~ or (b) settled with the Purcbaser any question of an abatement of the
purchase price arising out of such deficiency notice or work order, the Purchaser may at his option either (8) accept the real property subject
to such deficieney notice or work .order or (b) terminate Ibis Agreement. In the evenl of termination as aforesaid, all moneys paid hereunder
sball heretumed to the I'urcba8èr withoul inlerest or deductioas.
