THAT the proposal of Steven Nisbett dated June 21, 1990 be hereby accepted. 2. THAT the mayor and clerk are hereby authorized to sign, on behalf of The Corporation of the Town of Kincardine, the agreement with Mr. Nisbett, cited as Schedule "A", attached to and forming part of this by-law. 3. THAT this agreement shall remain in effect for a three-year term, commencing January 1, 1991, provided it is not ended by either party pursuant to the terms and conditions of said agreement. 4. THAT this by-law be cited as the "Steven Nisbett as Small Animal Control Officer, Appointment By-law 1990." By-law No. 1990 - 62 SCHEDULE "A" - AGREEMENT THIS AGREEMENT made in duplicate this 1990. òay of BE'l'WEEN: THE CORPORATION OF THE TOWN OF KINCARDINE (hereinafter called "the Town") OF ~HE FIRST PART - AND - STEVEN NISBETT of the Township of Kincardine in the County of Bruce (hereinafter called "NISBETT") OF THE SECOND PAR~ WITNESSETH that the parties hereto have agreed as tollows: 1. For the purposes of this agreement: a) "SMALL ANIMALS" means dogs, cats, which are making a nuisance Kincardine. or other small animals within the Town of 2. It shall be the duty of the SMALL ANHIAL cOlnROL OFFICLR to enforce all the by-laws of the Town of Kincardine and all the acts of the Provincial Legislature concerning the control of animals. ./ 4. 'l'he SMALL ANIMAL CONTROL OFFICER shall have all necessary authority for the seizure and impounding of small animals as may be required by the said by-laws or acts and shall take instructions from the chairperson of the committee for proection to Persons and property or in his/her absence the clerk-administrator of the Town of Kincardine. 5. a) The SMALL ANIMAL CONTROL OFFICER shall work a minimum of 15 hours per week, of which he shall patrol not less than 3 hours per day and not less than 4 days per week. b) The SMALL ANIMAL CONTROL OFFICER is required to notify the police off ice when he has impounded any animals, along with a description of said animal. c) 'l'he SMALL ANIMAL CONTROL OFFICER shall submi t to the clerk's office no later than the 2nd day of each month, a written statement of his activities for the past month on the prescribed form. 6. The SMALL ANIMAL CONTROL OFFICER shall, in addition to his normal patrol, be responsible for the care of all animals so impounded in the TOWN's small animal shelter and be responsible for the cleanliness of said shelter pursuant to provincial regulations. Cost of feeding and destroying the impounded animals shall be borne by the TOWN with invoices submitted in the name of the Town of Kincardine to the treasurer's office for payment. 8. The SMALL ANIMAL CONTROL OFFICER shall, at his own expense: a) Supply transportation in the performance of his duties. b) Dispose of the carcasses of dead dogs, cats, and other animals subject to all health and other regulations. 9. The SMALL ANIMAL CONTROL OFFICER shall have the cooperation of the Kincardine Police Service when issuing any summons. 10. The term of this agreement shall be for three years, commencing on the first day of January, 1991, and terminating on the 31st day of December, 1993. This agreement may be terminated by either party upon ninety (90) days' written notice to the other. 11. By-law No. 1990 - 0' 1. 2. 3. . 4. 5. 6. 7. 8. By-law No. 1990 -62 SCHEDULE "8" - DUTIES OF SMALL ANIMAL CONTROL OFFICER Maintain every room in the pound in a clean condition. Ensure that the pound is adequately ventilated. Ensure that adequate heat is provided for the comfort of every animal in the pound. Ensure that every animal is properly identified and that a complete record is maintained on each animal. Pens are to be properly sanitized. Properly clean and flush any gutter or drain in the pound. Ensure that adequate lighting is provided in the pound. . The folloowing method should be used in cleaning the pens: a) Loose feces or urine to be removed from the pen. b) Fecal material and dirt should be removed from walls and floors of the pen by using a stiff bristleå broom or handbrush. c) Pen walls, floor and rest board shoulã be sprayed with a suitable disinfectant. d) The entire pen should then be rinsed with hot water. e) Pen doors should be sanitized in a similar manner. f) The floor area of the pen should be squeegied to remove excess water. g) Animals to be removed from their cages during cleaning procedure. 9. Adequate amounts of suitable food and water are to be provided to each animal. 10. Every container for feed or water shall be maintained in a sanitary condition. 11. Impounded animals bearing identification are to be reporteà to the nearest office of the Ontario Society tor the Prevention of Cruelty to Animals, or any Society affiliated therewith. 12. Dispose of animals following the minimum redemption period which shall not be less than three days, excluding the day on which the animal was impounded and any holidays. 13. Euthaniasia of dogs must be performed in accordance with Section 20, 21, and 22, Ontario Regulation 140/71. 14. Generally, the SMALL ANIMAL CONTROL OFFICER is responsible to ensure the construction of the pound and care of the animals in the pound are in accordance with Ontario Regulation 140/71 and the Animals for Research Act. .
