BY-LAW NO. 1990-74
A BY-LAW TO AMEND BY-LAW NO. 1988-1, AS AMENDED, BEING THE
COMPREHENSIVE ZONING BY-LAW OF THE CORPORATION OF THE TOWN OF
KINCARDINE
WHEREAS Section 34 of the Planning Act, 5.0. 1983, Chapter I,
as amended, authorizes the councils of municipalities to enact
and amend zoning by-laws; and
AND WHEREAS the Council for The Corporation of the Town of
Kincardine has enacted By-law No. 1988-1 being a comprehensive
zoning by-law for the Town of Kincardine;
AND WHEREAS the Council for The Corporation of the Town of
Kincardine deems it advisable to amend By-law No. 1988-1;
NOW THEREFORE the Council for The Corporation of the Town of
Kincardine ENACTS as follows:

5.1. 4 .12
No. 1988-1, as amended, being the comprehensive
by-law of the Town of Kincardine, is hereby
amended by adding the following subsection
to Section 5.0 thereof:
5.1.4.12 Notwithstanding their "R1" zoning designation,
those lands described as part of Park Lot 35,
North side of King Street, Plan 4, in the Town
of Kincardine and identified by the zone symbol
"R1-11" on Schedule "A" of this By-law shall be
used in compliance with the provisions of the
"R1" Zone contained in this By-law, excepting,
however, that:
i) the provisions of subsection 4.8 shall not
apply;
ii) on those lands fronting onto the shoreline
of Lake Huron and identified by the zone
symbol "R1-11" and notwithstanding
subsection 4.2.2, an accessory detached
garage may be constructed within 1.0 metre
of the "front lot line" or, Block "B", Plan
638, whichever is applicable;
iii)

Schedule "A" of By-law No. 1988-1, as amended, is hereby
further amended by changing thereon from "RI" to "Rl-ll"
and "H" the zoning designation of those lands described
as part of Park Lot 35, North side of King Street, plan
4, in the Town of Kincardine, as shown outlined on the
attached Schedule "A".

3.
This By-law takes effect from the date of final passage
by Council and comes into force and effect pursuant to
the provisions of the Planning Act, 1983.
4.
This by-law may be cited as the "Fox/Matheson Zoning
By-law" .
