HomeMy WebLinkAboutKIN 90 029 Retail Bus.Holidays THE CORPORATION OF TH E TOWN OF KINCARDINE .' - BY-LAW BY-LAW NO. 1990 - 29 RETAIL BUSINESS HOLIDAYS BY-LAW WHEREAS under subsection 4(1) of the Retail Business Holidays Act (hereinafter called the Act) a municipality may, despite sections 2 and 3 of the Act, permit retail business establishments to be open on any holiday or may require that retail business establishments be closed on a holiday; AND WHEREAS the Council for The Corporation of the Town of Kincardine (hereinafter called the Council) deems it expedient to enact such a by-law and held a public meeting on April 19, 1990, notice of which was published in both the Kincardine News and the Independent, both newspapers having general circulation in the municipality, on March 14, 1990 and, at which, persons in attendance were given the opportunity to make representations in respect of the proposed by-law; AND WHEREAS in determining whether or not the proposed by-law should be passed, the Council had regard to the following published criteria established by the Council as a plan under subsection 4(5) of the Act, namely: (a) the comments, if any, from the local Member of the Legislative Assembly in response to them of the proposed by-law, (b) the representations of persons in attendance at the public meeting, (c) the original submissions of the Kincardine and District Chamber of Commerce and the Board of Management for the Business Improvement Area, (d) the comments, if any, of any agency, local board, or commission having an interest in the proposed by-law, (e) the conditions prevailing in the subject retail market area, (f) any other matter that, in the opinion of the Council is relevant. . .. ./2 . . Page 2 Retail Business Holidays By-Law No. 1990 - 29 NOW THEREFORE the Council of The Corporation of the Town of Kincardine ENACTS as follows: 1. Despite section 2 and pursuant to subsection 4(1) of the Act, retail establishments in the Town of Kincardine may be open on holidays as defined in the Act from the Victoria weekend to the Thanksgiving Day weekend inclusive and from December 1 to December 24, inclusive in each year. 2. This by-law shall be administered and enforced by the Kincardine Police Service. 3. That By-law No. 4738 passed on the 8th day of May, 1986 be and the same is hereby repealed. 4. Where there is a conflict between the provisions of the Retail Business Holidays Act and the provisions of this by-law, the provisions of the Act shall prevail. 5. This by-law shall come into full force and effect on May 20, 1990. 6. This By-law shall be known as the "Retail Business Holidays By-Law" .
