THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW
BY-LAW NO. 1990 - 33
THE CHRISTOPHER FITNESS CONNECTION REZONING BY-LAW
WHEREAS Section 34 of The Planning Act, 5.0. 1983, Chapter 1
authorizes the councils of municipalities to enact and amend zoning
by-laws which comply with approved official plans;
AND WHEREAS the Council of The Corporation of the Town of
Kincardine has enacted By-law 1988-1, a zoning by-law enacted under
Section 34 of the said Planning Act;
AND WHEREAS the Council of The Corporation of the Town of
Kincardine desires to amend such by-law;
AND WHEREAS this by-law complies with Amendment No. 2 to the Town
of Kincardine's Official Plan adopted by Council on November 2,
1989.
NOW THEREFORE the Council of The Corporation of the Town of
Kincardine ENACTS as follows:
1. By-Law No. 1988-1, as amended, being the Comphrehensive Zoning
By-Law of The Corporation of the Town of Kincardine, is hereby
further amended by adding the following Subsection 5.1.4.10
to Section 5 thereof:
5.1.4.10 Notwithstanding their 'R1' Zoning designation, those
lands described as Lots 5 and 6, West side of Huron
Terrace, Plan 4 in the Town of Kincardine and
identified by the Zone Symbol 'R1-9' on Schedule "A"
of this By-Law shall be used in compliance with the
provisions of the 'R1' Zone contained in this By-
Law, excepting, however, that:
(i) the uses permitted within the existing building
may include one or more of the following uses:
a dance studio
a health and fitness centre
one accessory residential dwelling unit
a lounge and racquet sports facilities
(ii) the expansion or enlargement of the existing
building may be permitted to accommodate the
expansion of the dance studio and accessory
apartment, provided that such expansion or
enlargement:

is situated in the rear yard
provides a side yard along the northern
extent of the side yard established by the
existing building;
does not exceed a coverage greater than
25% of the combined area of Lots 5 and 6.
(iii) for the purposes of this Subsection, the word
"existing" shall mean existing on the date of
passage of the Town of Kincardine Comprehensive
Zoning By-Law No. 1988-1.
(iv) any residential dwelling unit accessory to a
permitted non-residential use shall only be
used as the principle residence of the owner,
manager, or care-taker and shall comply with
the dwelling unit floor area requirements of
Subsection 5.3.8 of this By-Law.
2. Schedule "A" of By-Law No. 1988-1, as amended, being the
Comprehensive Zoning By-Law for the Corporation of the Town
of Kincardine is hereby further amended by changing thereon
from 'R l' to 'R 1-9' the zoning designation of those lands
described as Lots 5 and 6, w/s of Huron Terrace, Plan 4 Town
of Kincardine, as shown outlined by the broken line on the
attached Schedule "A".
3. This By-Law takes effect from the date of passage by Council
and comes into force pursuant to the provisions of the
Planning Act, 1983.
4. This By-Law shall be cited as the "Christopher Fitness
Connection Re-Zoning By-Law".
