BY-LAW
BY-LAW NO. 1990 - 52
BEING A BY-LAW TO REZONE LOTS 15 AND 16, SOUTH SIDE OF
MECHANICS AVENUE, PLAN 4 TO R4-3
WHEREAS Section 34 of the Planning Act, S.O. 1983, Chapter 1,
authorizes the Councils of Municipalities to enact and amend Zoning
By-Laws which comply with approved Official Plans;
AND WHEREAS the Council of the Corporation of the Town of
Kincardine has enacted By-Law No. 1988-1, a Zoning By-Law enacted
under Section 34 of the said Planning Act;
AND WHEREAS the Council of the Corporation of the Town of
Kincardine desires to amend such By-Law;
AND WHEREAS this By-Law complies with the Town of Kincardine's
Official Plan which was approved by the Minister of Municipal
Affairs on January 31,1989;
NOW THEREFORE the Council of the Corporation of the Town of
Kincardine ENACTS as follows:
1. By-Law No. 1988-1, as amended, being the Comprehensive Zoning
By-Law of the Corporation of the Town of Kincardine is hereby
further amendeã by adding the following item 5.4.3.3 to
Subsection 5.4.3 thereof:
5.4.3.3
Notwi thstanding thei r 'R4' Zoning designation, those
lands described as Lots 15 and 16, south side of
Mechanics Avenue, Plan 4, in the Town of Kincardine
and delineated as 'R4-3' on Schedule "A" of this
By-Law shall be used in compliance with the
provisions of the 'R4' Zone contained in this By-
Law, excepting, however, that:
i) notwithstanding Subsection 4.12.6, the required
7.5 metre setback for a parking area may be
reduced to 3.35 metres from Huron Terrace for
the area south of the existing apartment
building.

Schedule "A" of By-Law No. 1988-1, as amended, is hereby
further amended by changing thereon from 'R4' to 'R4-3' the
Zoning designation of those lands described as Lots 15 and 16,
south side of Mechanics Avenue, Plan 4, in the Town of
Kincardine, as shown outlined on the attached Schedule "A".

3. This By-Law shall take effect from the date of passage by
Council and comes into force pursuant to the provisions of the
Planning Act, 1983.
4.
This By-Law shall be cited as the "Waycar Development Inc. Re-
zoning By-Law."
