THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2008 -139
BEING A BY-lAW TO AMEND BY-lAW NO. 2007 - 272
(AUTHORIZING A SITE PLAN AGREEMENT WITH JOHN HERMAN ROPPEl
AND ENBRIDGE ONTARIO WIND POWER lP for Lt 11, Con 5, Bruce)
WHEREAS the Planning Act, R.S.O. 1990, P.13, Section 41, authorizes
municipalities to enter into Site Plan Agreements;
AND WHEREAS the Council of the Municipality of Kincardine passed By-law No.
2007 - 272 authorizing a Site Plan Agreement with John Herman Roppel and
Enbridge Ontario Wind Power LP, for that property located at Lot 11, Concession
5, Bruce, Part Lot 11-13, Concession 6, Bruce as in R276599, R320292, Except
Part 1 & 2 3R992, Part 1 3R5336; 8fT BU13710; Municipality of Kincardine in the
County of Bruce;
AND WHEREAS Council now deems it advisable to release a portion of the said
lands from the Site Plan Agreement;
NOW THEREFORE the Council of The Corporation of the Municipality of
Kincardine ENACTS as follows:
1.
That the lands described as Part 1 of Plan 3R - 8539 (geographic
Township of Bruce), Municipality of Kincardine, County of Bruce, attached
hereto as Schedule "A" are released from the Site plan Agreement
authorized by By-law No. 2007 - 272 and registered as Instrument #
BR7413.
2.
That the Mayor and CAO be hereby authorized and directed to execute
such documents, on behalf of The Corporation of the Municipality of
Kincardine, as required for the Release of Site Plan Agreement for the
said lands.
3. This By-law shall come into full force and effect upon its final passage.
4. This By-law may be cited as the "Amend By-law No. 2007 - 272 By-law."
