WHEREAS By-law No. 1990-88, being the consolidated Personnel By-law for The Corporation of the Town of Kincardine was passed on the 20th day of December, 1990. AND WHEREAS the Council for The Corporation of the Town of Kincardine deems it expedient to amend sections of By-law 1990-88; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. That clause 6.3 of By-law No. 1990-88 is hereby repealed and replaced with the following: 116.3a: Annual vacation for all permanent full-time employees shall be as follows: (a) Two continuous Employment weeks' vacation after service (to be paid standards Act). one full pursuant year to of the . (b) Three weeks' vacation after three full years of continuous service (to be paid at the employee's regular weekly earnings, not including overtime or any other payment(s), for the vacation period). (c) Four weeks' vacation after ten full years of continuous service (to be paid at the employee's regular weekly earnings, not including overtime or any other payment(s), for the vacation period). (d) Five weeks' vacation after twenty full years of continuous service (to be paid at the employee's regular weekly earnings, not including overtime or any other payment(s), for the vacation period). (e) six weeks' vacation after twenty-five full years of continuous service (to be paid at the employee's regular weekly earnings, not including overtime or any other payment(s), for the vacation period). 6.3b: Annual vacation for all permanent part-time employees shall be as follows: (a) Two weeks' vacation after one full year of continuous service (to be paid pursuant to the Employment Standards Act); (b) Three weeks' vacation after three full years of continuous service (to be paid at 6% of previous calendar year's regular earnings or 4% of gross earnings, whichever is greater); 1. (cont'd) Page 2 Consolidated Personnel Amendment By-law 1991-46 (c) Four weeks' vacation after ten full years of continuous service (to be paid at 8% of previous calendar year's regular earnings or 4% of gross earnings, whichever is greater); . (d) Five weeks' vacation after twenty full continuous service (to be paid at 10% of calendar year's regular earnings or 4% earnings, whichever is greater); years of previous of gross (e) Six weeks' vacation after twenty-five full years of continuous service (to be paid at 12% of previous calendar year's regular earnings or 4% of gross earnings, whichever is greater).1I 2. That new clause 37.0, as follows, be hereby added to the by-law: "37.0 37.1 37.2 37.3 37.4 37.5 . NEGOTIATION PROCESS The Council will, at the beginning of its term, appoint one councillor who will be responsible for personnel matters. That councillor, the mayor, the clerk-administrator, and the treasurer will be responsible for annual salary and benefit negotiations with the employees, and will report to and receive direction from the committee of the whole in camera as required. The employees will choose from amongst themselves a IInegotiating committee II , which will consist of no more than five members, who will be the liaison between the employees and the negotiating committee of council. On or before october 1st of each year, the employees will select their committee and present to council, in writing, their requests for salary and benefits for the following year. The council negotiating committee will then meet with the committee of the whole, in camera, and schedule a meeting with the employee committee to discuss the requests. This negotiating process may require several meetings. It is the general intention of the Council to conclude the negotiating process prior to January 1st; however, in an election year, this may be impossible, and the out-going council may wish to leave the salary negotiations for the new council to carry out. In this case, the employee committee will be required to adjust to council's schedule. Nothing in this section will preclude and employees from agreeing to a salary and benefit package. the council multi-year 3. This by-law shall come into full force and effect retroactive to January 1, 1991. 6. This by-law may be cited as the "Consolidated Personnel Amendment By-law".
