BY-LAW BY-LAW NO. 1991 - 56 A BY-LAW TO AMEND BY-LAW NO. 1988-1 IN ORDER TO REZONE PART OF PARK LOT 13 EAST OF PARK STREET AND PART OF PARK LOT 1 NORTH OF KINCARDINE AVENUE, PLAN 61 FROM 'Rl' AND 'OS' TO 'RI-12' AND 'H' . WHEREAS Section 34 of the Plannina Act, S.O. 1983, Chapter 1 authorizes the councils of municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of The Kincardine has enacted By-law No. enacted under section 34 of the said Corporation of the 1988-1, a zoning Plannina Act; Town of by-law AND WHEREAS the Council of The Corporation of the Town of Kincardine desires to amend By-law No. 1988-1; AND WHEREAS this By-law complies with the Kincardine's Official Plan which was approved by the of Municipal Affairs on January 31, 1989; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: Town of Ministry 1. By-law No. 1988-1, as amended, is hereby further by adding the following Subsection 5.1.4.13 to 5.0 thereof: amended Section 5.1.4.13 - Notwithstanding their 'Rl' zoning designation, those lands described as Part of Park Lot 13, East of Park Street, and Part of Park Lot I, North of Kincardine Avenue, Plan 61, in the Town of Kincardine and identified by the zone symbol 'R.I-12', on Schedule 'A' to this by-law , may be used in compliance with the 'R-l' zone provisions contained in this By-law, excepting, however, that: i) for the purpose shall be defined between lot lines. of this subsection, "Lot as the total horizontal Area" area . 2. Schedule 'A' of By-law No. 1988-1, as amended, is hereby· further amended by changing thereon from 'Rl' and 'OS' to 'RI-12' and 'H' the zoning designatioin of those lands described as Part of Park Lot 13, East of Park Street, and Part of Park Lot I, North of Kincardine Avenue, Plan 61, Town of Kincardine, as shown outlined on the attached Schedule 'A' and more specifically on the attached Schedule 'B' to this By-law. . . By-law 1991-56 Lynden Estates Zoning This by-law shall take effect from the date of final passage by Council and comes into full force and effect pursuant to the provisions of the Plannina Act, 1983. 3. 4. This by-law may be cited as the "Lynden Estates Zoning By-law". READ a FIRST and SECOND time this 6th day of June, 1991.
