BY-LAW NO. 1991-58
A BY-LAW TO CLOSE PARTS OF PARK LANE, DURHAM STREET, SOUTH
STREET AND JAMES STREET FOR CONSTRUCTION.
WHEREAS The corporation of the Town of Kincardine has
authorized construction on parts of Durham street, Park Lane,
South Street and James Street which are pUblic highways opened
for public use;
AND WHEREAS Subsection 208(43) of the Municipal Act,
R.S.D. 1980, Chapter 302, as amended, authorizes the councils
of all municipalities to close on a temporary basis any highway
under the jurisdiction of the municipality for any period
during the construction, repairing or improvement of such
highway or portion thereof¡
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. That part of Durham Street between Victoria Street and
Park Lane, part of Park Lane between Durham Street and
south Street, part of South Street between Park Lane and
and James Street, and part of James Street between Park
Lane and Broadway be closed to all vehicular traffic
during the period of construction authorized by By-law
No. 1991-57.

2. The contractor shall provide and keep in repair a
reasonable alternative temporary route for traffic and
for all property owners who cannot obtain access to their
property by reason of such closing.
3. The contractor shall erect at each end of such highway or
portion thereof, and where an alternative route deviates
therefrom, a barricade upon which an adequate warning
device shall be exposed and in good working order
continuously from sunset until sunrise and at such points
there shall be erected a detour sign indicating the
alternative route and containing a notice that the
highway is closed to traffic.
The contractor shall provide and keep in repair a
reasonable temporary route for pedestrian traffic between
the Kincardine and District Secondary school and the
portable classrooms located on the west side of Park Lane
during construction.

5. Every person who uses a highway or portion of a highway
so closed to traffic does so at his or her own risk and

for any damage sustained by a person using the highway or
portion thereof so closed to traffic.

Every person who without lawful authority uses a highway
or portion thereof so closed to traffic while it is
protected in accordance with this paragraph, or who
removes or defaces any barricade, device, detour sign or
notice placed thereon by lawful authority , is guilty of
an offence and is subject to the penalties as set forth
in the Provincial Offences Act and is also liable to the

or injury occasioned by such wrongful use, removal or
defacement.
7. This by law shall come into full force and effect upon
its final passage.
8. This by-law may be cited as the "Temporary Closure of
streets for Contruction By-law, 1991".
