BY-LAW NO. 1991-59
TO BY-LAW TO ADOPT AMENDMENT NUMBER 4 TO THE OFFICIAL PLAN FOR
THE TOWN OF KINCARDINE.
WHEREAS the recommendation has been made to the Council
of The Corporation of the Town of Kincardine that the
Explanatory Text and Schedule "A" constituting Amendment No. 4
to the Official Plan for the Town of Kincardine, be adopted by
Council in accordance with the provisions of the Planning Act,
1983.
NOW THEREFORE the Council for The corporation of the Town
of Kincardine ENACTS as follows:
1. That Amendment No. 4 to the Official Plan for the Town
of Kincadine, a copy of which is attached hereto and
forms part of this by-law, is hereby adopted.
2. That the Clerk is hereby authorized and directed to make
application to the Minister of Municipal Affairs for the
approval of the aforementioned Amendment No. 4 to the
Official Plan for the Town of Kincardine.
3. This by-law shall come into full force and effect upon
its final passage.
4. This by-law may be cited as the "Adopt Amendment No. 4
to the Official Plan, By-law".

This Amendment No. 4 to the Official Plan for the Town
of Kincardine, which was adopted by the Council of the
corporation of the Town of Kincardine, is hereby
modified as follows:
1.
Scbe4u1. "A" which forms part of Amendment No.4 is
hereby modified by deleting "Amendment No.3" on
the schedule to read as "Amendment No.4".

As thus modified, Amendaent No. 4 is hereby approved
under Sections 17 and 21 of the Planning Act.

The Explanatory Text and Schedule "A" constituting Amendment No. 4
to the Town of Kincardine Official Plan was recommended to the
Council of the Corporation of the Town of Kincardine on the 18th
day of Julv , 1991.

PART A
THE PREAMBLE
PURPOSE
of this Amendment is to redesignate certain lands
Town of Kincardine, as shown on the attached Schedule
'Residential' and 'General Commercial' (with limited
'General Commercial' (with full range of normally
uses) .
The purpose

This Amendment applies only to those lands located within the north
end of the Town of Kincardine, on the north side of King Street,
west of Gary Street, and comprising the westerly parts of Blocks
'F' and 'H' of Registered Plan M-1.
BASIS
The subject 1 ands are current 1 y vacant and have an area of
approximately 4720 square metres (50,800 square feet). The lands
surrounding the subject property are characterized by mixed uses.
To the east is a shopping centre and motel/restaurant which are
designated 'General Commercial'. The lands to the south of the
sUbject property are designated 'Highway Commercial' and are
characterized by commercial and residential uses. To the north of
the subject lands are townhouses and to the west is a parcel of
vacant land. Further to the west is Trillium Court, a senior's
apartment complex. All of these normally and westerly lands are
designated 'Residential'.
The current 'Residential' designation applies only to a small
portion of the south-easterly section of the sUbject lands. The
current 'General Commercial' designation of the sUbject lands
limits their use to primarily service-oriented commercial uses.
The proposed 'General Commercial' designation would permit a wide
range of both service-oriented and general retail uses. This wider
range of commercial use to-date has been limited to the downtown
core and the existing shopping plaza to the east.
The Official Plan policies regarding commercial development are
designed to maintain the Central Business District (CBD) as the
primary focus of business activity within the Town.- Accordingly,
new general retail uses are encouraged to located within the
Downtown or the existing shopping plaza located to the east of the
subject lands. Indications are that there is currently a shortage
of good available commercial space in the downtown area, suggesting
that the CBD is viable and that the proposed development should
have a minimal effect on the downtown core.

In addition, the proposed commercial centre is expected to offer a
different type of development and retail mix than that associated
with the existing Sutton Park Mall.
The road network in this area wi 11 provide good access to the
proposed development. The primary access to the proposed
commercial centre will be from Gary Street. There will be no direct
access to the proposed development from King Street, which is an
arterial road according to the Schedule "c" of the Town of
Kincardine Official Plan.
The necessary prerequisites for new development on the subject
lands would include site plan controls and an amendment to the
Town's Comprehensive Zoning By-Law.

All of this part of the Amendment entitled Part B - The Amendment -
consists of the fOllowing text and map constituting Amendment No.
4 to the Official Plan of the Town of Kincardine.
DETAILS OF THE AMENDMENT
1. Schedule "A" of the Official Plan of the Town of Kincardine is
hereby amended by redesignating from 'Residential' and
'General Commercial' (with 1 imited uses) to 'General
Commercial' (with the full range of normally permitted uses),
the area outlined on the attached Schedule "A".

Amendment to the Town of Klncardine Officlal Plan and an Amendment
to the Town of Kincardine Comprehensive Zoning By-Law No. 1988-1 I
as amended.
Presently! the 'General Commercial' policies of the Official
Plan state that the commercial uses permitted on the subject lands
shall be 1 imited to primari ly service oriented commercial uses.
Similarly. the present Zoning of the lands limits the permitted
uses to service oriented uses such as (but not limited to) business
offices, convenlence stores. financial institutions or service
shops.
If approved, the applicant's proposal would amend the Official
Plan and Zoning By-Law to permit the wider range of commercial uses
which are permitted in the 'C2 - Shopping Centre' Zone.
A 'Key Map' has been provided on the reverse of this form.
