THE CORPORATION OF THE TOWN OF KINCARDINE

BY-LAW NO. 1991-60
A BY-LAW TO AMEND THE FENCING OF SWIMMING POOLS BY-LAW.
WHEREAS Kincardine Town council passed By-law No. 4555
being a by-law to provide for the fencing of privately owned
swimming pools in the Town of Kincardine.
AND WHEREAS Kincardine Town Council deems it expedient to
amend By-law No. 4555 in order to amend the regulations with
respect to height of certain fences and with respect to the
number of gates.
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. That Section 1 of By-law No. 4555 be hereby deleted and
replaced with the following:
1. In this by-law:
(a) "Fence" means either
(i) Chain link fencing, of at least 13 gauge,
of not less than one and two-tenths metres
(1.2 m) and supported by iron posts set in
concrete to a depth of at least six-tenths
metres (0.6 m) and spaced not more than
three metres (3 m) apart, with a
supporting rail along the top of the fence
between the posts; or
(ii) A privacy fence with the material
installed vertically and such fence being
not less than one and two-tenths metres
(1.2 m) in height.

(b) "Swimming Pool" means any structure, basin,
chamber, or tank containing any artificial body
of water for swimming, diving or recreational
bathing and having a water depth of
seven-tenths of a metre (0.7 m) at any point.
That Section 3 of By-law No. 4555 be hereby deleted and
replaced with the following:
3. Every fence shall have at least one gate which
shall be the same height as the fence, shall be
supported by substantial hinges and shall be
equipped with a self-closing, self-locking device
which shall be placed on the top on the inside of
the gate.

3. That Section 4 of By-law No. 4555 be hereby deleted and
replaced with the following:
4. Such fence shall be so located that entry to the
swimming pool area shall be possible only be means
of a gate or gates in the enclosed fence.
4. That Section 7 of By-law No. 4555 be hereby deleted and
replaced with the following:
7. Such gates shall be kept closed and locked at all
times when the owner of the swimming pool or his or
her duly authorized agent is not present and
supervising the swimming pool.
5. This by-law shall come into full force and effect upon
its final passage.
6. This by-law may be cited as the "Fencing of Swimming
Pools Amendment By-law, 1991".
