HomeMy WebLinkAboutKIN 91 082 Close Durham Mket Sq THE CORPORATION OF THE TOWN OF KINCARDINE . BY-LAW BY-LAW NO. 1991-82 A BY-LAW TO CLOSE DURHAM MARKET SOUTH FOR COMMUNITY PURPOSES. WHEREAS the Kincardine Pentecostal Church has the closure of Durham Market South in order that present "Bethlehem Live" in victoria Park; requested they can AND WHEREAS Subsection 208(44) of the Municipal Act, R.S.O. 1980, Chapter 302, as amended, authorizes the councils of all municipalities to close on a temporary basis any highway under the jurisdiction of the municipality for any period for such social, recreational, community, athletic or cinimatographic purpose as the council specifies; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. That Durham Market South be closed traffic from 6:00 p.m. to 10:00 p.m. 20, 1991. to all vehicular on December 19 and 2. The Kincardine Pentecostal Church shall provide and keep in repair a reasonable alternative temporary route for traffic and for all property owners who cannot obtain access to their property by reason of such closing. 3. The Kincardine Pentecostal Church shall arrange for the erection, through the public works department, at each end of such highway or portion thereof, and where an alternative route deviates therefrom, a barricade upon which an adequate warning device shall be exposed and in good working order continuously from sunset until 10:00 p.m. and at such points there shall be erected a detour sign indicating the alternative route and containing a notice that the highway is closed to traffic. . 4. Every person who uses a highway or portion of a highway so closed to traffic does so at his or her own risk and The Corporation of the Town of Kincardine is not liable not liable for any damage sustained by a person using the highway or portion thereof so closed to traffic. Every person who without lawful authority uses a highway or portion thereof so closed to traffic while it is protected in accordance with this by-law is guilty of an offence and is subject to the penalties as set forth in the Provincial Offences Act and is also liable to the The Corporation of the Town of Kincardine for any damage or injury occasioned by such wrongful use, removal or defacement. 5. .. ./2 ~ . .
