THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW BY-LAW NO. 1991-19 A BY-LAW TO PROVIDE FOR RULES AND REGULATIONS CONCERNING THE BLUEWATER TRAILER PARK WHEREAS the Council for The corporation of the Town of Kincardine has assumed the operation of the Bluewater Trailer Park and enacted By-law No. 1989-58 established certain rules and regulations in order to ensure the park operates in an orderly fashion to the benefit of the public and users; AND WHEREAS the Council for The Corporation of the Town of Kincardine wishes to replace By-law No. 1989-58; NOW TBEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. 2. The Bluewater Trailer Park (hereinafter called the Park) shall be composed of Lots 5 to 8, Plan 335 on the East side of Saugeen street in the Town of Kincardine (approximately 2.09 acres). The Corporation of the Town of Kincardine (hereinafter called the Town) shall operate the Bluewater Trailer Park as a recreational vehicle campground and the rules governing the use of the Park are outlined in this by-law. Anyone renting any sites in the Park shall pay such fees as are outlined in the Town's Consolidated Fee By-law. 4. Anyone renting any sites in the Park shall vacate the Park by 12:00 noon of the scheduled day of departure unless arrangements are made to extent their stay for the prescribed fees. 3. 5. No person shall operate a vehicle in excess of 5 km. per hour in the Park. 6. Every person wishing to rent a site in the Park shall register and pay in advance before occupying a site. 7. . 8. Improper conduct by any person or visitor disturbing or objectionable to other campers will not be tolerated. Such conduct will result in eviction from the camp, without refund. All parties, music, T.V., singing, etc. must be kept within reasonable sound levels at all times. All noise shall cease by 11:00 p.m., and all visitors not remaining overnight shall be required to leave the park by 11:00 p.m. . 11. The Town reserves the right to eject any person or persons for undesirable conduct. 12. Pets shall be kept under the control of owners at all times. Every person who owns, harbours, possesses or is in control of any dog shall remove forthwith and dispose of any excrement left by said dog on any property in the Park in accordance with the "Dog Control By-law". 13. No person shall mark or deface, cause damage, remove fittings or other property from any building. No person shall modify any service boxes or electrical outlets. 14. All buildings and washrooms are for the convenience of the campers and shall be kept in a clean and tidy manner. No person shall allow their children to play in any building or washroom. 15. No person shall remove any lot markers or stakes at any time. 16. No person shall operate motor bikes or mini-bikes in the park except for essential transportation purposes. 17. Essential emergency calls for campers; i.e. sickness or accident, will be received by the park office telephone or by the Kincardine Police service after regular Park hours. 18. No person shall sub-let any site. 19. The Town is not responsible for any loss or damage to any camping unit or personal property. Coolers, stoves and all valuables shall be kept inside the unit upon retiring or when left unattended. 20. Reservations on seasonal lots shall be on a first-come, first-serve basis. A $50.00 deposit will reserve a site. The deposit will be refunded only if the Town is notified of cancellation by March 31st of the year of rental less a $10.00 administration fee. All seasonal rental fees become due and payable by May 15th. . 22. The trailer continuing year. Camping units and appurtenances may be stored on the site from october 31st to May 15th in any year upon payment of the prevailing storage fee. Park shall not be occupied by any person on a basis from october 31st to May 15th in any 21. 23. No person shall erect or construct any building or addition to the camping unit or site, other than a flat, unfenced, moveable deck. Every person shall restore the site to its original condition when either the trailer or deck or both are removed. . The maximum length allowable for a travel trailer or camper unit on any trailer park site is 10.66 metres (35 feet) measured from the rear bumper to the front bumper to dip of the tongue, whichever is longer. 26. Every person shall maintain their respective sites in a clean and tidy condition. 25. 27. No person shall remove a picnic table from any site. 28. No person, other than a registered camper, shall use the Park's facilities or garbage receptacles. 29. Anyone found in contravention to the rules and regulations of this By-law may be required to vacate the Bluewater Trailer Park within 24 hours of personally being served with a written notice to vacate. 30. No person shall remain on, or fail to remove a trailer, tent or other property situated in the Park, after receiving a notice as provided in Section 29 above. 31. Bluewater Trailer Park attendants may remove any trailer, tent or other property of a person receiving notice under Section 4 anytime after the 24 hours has expired. 32. Any costs associated with the removal of a trailer, tent or other property, authorized by the By-law are the sole responsibility of the owner of such property. 33. All provisions of this By-law may be enforced by police officers and by-law enforcement officers throughout the jUdicial district of the Town of Kincardine. 34. By-law No. 1989-58 passed on the 18 day of May, 1989 be and the same is hereby repealed. 35. This by-law shall come into full force and effect upon its final passage. 36. This by-law may be cited as the "Bluewater Trailer Park By-law". READ a FIRST and SECOND time this 21st day of February, 1991. . (\ " / , /) ,..
