BY-LAW NO. 1991-23
A BY-LAW TO ESTABLISH PLUMBING INSPECTIONS AND PROVIDE FOR FEES
FOR PLUMBING INSPECTIONS FOR THE TOWN OF KINCARDINE.
WHEREAS

NOW THEREFORE the council for The Corporation of the Town
of Kincardine ENACTS as follows:

to provide for the inspection of plumbing, the
plans, and issuing of permits in connection
1 . 0 DEFINITIONS
1.1 In this By-law, "plumbing inspector" shall be an
inspector appointed by the Town of Kincardine and under
the jurisdiction of the chief building official.
2.0 CONSTRUCTION
2.1 No person shall construct, repair, renew or alter
plumbing except in conformity with the regulations under
The Ontario Water Resources Act, R.S.a. 1980, Chapter
361, respecting Plumbing as approved by the Lieutenant
Governor in Council and amendments thereto, and all
plumbing and drainage work performed within the said
municipality shall be carried out and subject to the
inspection, supervision and approval of the plumbing
inspector.
2.2 This by-law does not apply to:
(i) the repairing or replacement of a valve, faucet, or the
repairing of a leak or forcing out of a stoppage.

2.3 After a plan or specification has been approved, no
alterations or deviations from the same shall be allowed
except upon the written application of the plumber,
worker or his agent and with the approval of the plumbing
inspector.
Where a dwelling house or other building is erected in a
location wherein it is impossible or unreasonable to
connect the same to a public sewer, a septic tank system
may be installed providing that a special permit
therefore is obtained from the Bruce-Grey-owen Sound
Health unit. Any septic tank system so installed must be
constructed and operated in conformity with such
regulations and conditions as may be imposed from time to
time by the said health unit.

2.5 It shall be permissible for an owner to personally
perform plumbing work on his own property providing that
a permit is procured therefore, and that the work
complies with the said by-law and is approved by the
plumbing inspector.

All work covered by this by-law shall be done in a proper
manner and shall be subject to the inspection and
approval of the plumbing inspector, and all faulty or
defective work which may at any time be discovered, shall
be made perfect to the satisfaction of the plumbing
inspector and when so found satisfactory, a completion
certificate shall be issued to the plumber, worker or
owner, unless in the meantime such work shall have become
faulty or defective.
3.0 PERNnTS
2.6
3.1 Before proceeding to construct, re-construct, alter or
relay any portion of the plumbing, drainage system, of
any building located within the limits of this
municipality, the plumber, worker, homeowner and/or
property owner, shall file in the office of the plumbing
inspector an application for a permit therefore" and
such application shall be accompanied by a plan thereof,
showing the location of the building and the details of
its drainage system.
3.2 The plumber or worker shall be responsible for all work
whether the permit is taken out in the name of the
plumber, worker, homeowner and/or property owner.
3.3 All plans shall show the sizes of all drainage pipes and
shall be legibly drawn in ink on heavy white paper or
tracing linen or on a blueprint or in any manner
satisfactory to the plumbing inspector.
3.4 Should the plumbing inspector find that a plan and
specifications as filed, does not conform with said
regulations, he shall not issue a permit and it shall be
unlawful for the plumber or worker or any other person to
proceed with the work referred to in the application.
3.5 A permit shall be granted or refused by the plumbing
inspector within seven days from the time of filing the
application and if granted shall be valid for six months
from the date of issue. Every permit shall automatically
expire if:
(a) the work authorized by such permit is not commenced
within six (6) months from the date of issue of the said
permit; or
(b) after the commencement of the work authorized by such
permit, the work is suspended or abandoned for a period
of six (6) months or more.
4.0 INSPECTIONS
4.1
(i) Where plumbing has been constructed, repaired,
renewed or altered, no person shall put such plumbing
system into use until such time as all tests required by
the regulations or plumbing inspector have been
conducted, and the work involved has been inspected and
found by the inspector to conform to the regulations.
The plumber/homeowner shall be required to notify the
plumbing inspector that the work has been completed and
is ready for a final inspection.
(ii) Subsection (i) does not apply to:
(a) the repairing or replacement of a valve or faucet; or
(b) the repairing of a leak or forcing out of a stoppage.

All equipment, materials, power and labour shall be
furnished by either the plumber, worker, homeowner or
property owner, and all tests shall be made in the
presence of an inspector.
No person shall require the inspector to make the
inspection required as aforesaid by the said regulations
unless and until he has paid to the Town of Kincardine
the appropriate fee as provided in the Town's
Consolidated Fee By-law, as amended.
4.4 The plumbing inspector who has reason to believe that
defective or unauthorized plumbing or connections thereto
exist, may at all reasonable hours enter the premises to
inspect same.

5.0 FEES
5.1 That it is hereby imposed and shall be collected by the
plumbing inspector or chief building official from the
plumber, worker, homeowner and/or property owner the
permit and inspection fees as set out in the Town's
Consolidated Fee By-law, as amended.
5.2 All fees collected by the plumbing inspector and/or chief
building official shall be paid to the Town's treasurer
within one (1) month of the receipt thereof together with
an explanatory statement.
5.3 The number of fixture units outlined in the Consolidated
Fee By-law shall be determined in accordance with the
following schedule:
1 water closet is equivalent to .............. 6 units
1 wash basin is equivalent to ................ 1 unit
1 bath tub is equivalent to .................. 2 units
1 kitchen sink is equivalent to .............. 2 units
1 laundry tub is equivalent to ............... 2 units
1 shower stall is equivalent to .............. 2 units
1 urinal is equivalent to .................... 2 units
1 three-compartment sink is equivalent to..... 3 units
1 slop sink is equivalent to ................. 3 units
1 outlet for automatic (washer) laundry is
equivalent to .......................................................... 2 units
project and lab sinks ........................ 1 unit
6.0 ENFORCEMENT
6.1
Any per~on who contravenes any of the provisions
by-law ~s guilty of an offence and is subject
penalties as set forth in the Provincial Offences
of this

7.0
This by-law shall come into full force and effect upon
its final passage.
This by-law may be cited as the "Plumbing Inspection
By-law".
8.0
