BY-LAW BY-LAW NO. 1992-98 TO BY-LAW TO ADOPT AMENDMENT NUMBER 5 TO THE OFFICIAL PLAN FOR THE TOWN OF KINCARDINE. WHEREAS the recommendation has been made to the council of The corporation of the Town of Kincardine that the Explanatory Text and Schedule "A" constituting Amendment No. 5 to the Official Plan for the Town of Kincardine, be adopted by Council in accordance with the provisions of the Planning Act, R.S.O. 1990, C.P.13.; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. That Amendment No. 5 to the Official Plan for the Town of Kincardine, a copy of which is attached hereto and forms part of this by-law, is hereby adopted. 2. That the Clerk is hereby authorized and directed to make application to the Minister of Municipal Affairs for the approval of the aforementioned Amendment No. 5 to the Official Plan for the Town of Kincardine. 3. This by-law shall come into full force and effect upon its final passage. 4. This by-law may be cited as the "Amendment No. to the Official Plan Amendment By-law". 5 READ a FIRST and SECOND time this 5th day of November, 1992. AMENDMENT NO. 5 TO THE OFFICIAL PLAN FOR THE TOWN OF KINCARDINE . .. .' . ., · AMENDMENT NO. 5 TO THE OFFICIAL PLAN FOR THE TOWN OF KINCARDINE This Amendment No. 5 to the Official Plan for the Town of Kincardine which was adopted by the Council of the Corporation of the Town of Kincardine is hereby modified as follows: section D.7.4 - Waste Management policies, subsection 5 is deleted in its entirety and replaced with the following: · "D7.4.5 New Waste management facilities shall be established by Amendment to the zoning By-law, and shall be subject to regulations/policies prescribed under such statutory authority as the Planning Act, the Environmental Assessment Act, the Environmental Protection Act and/or the ontario Water Resources Act." PART A THE PREAMBLE PURPOSE The purpose of this Amendment is two fold: (i) to establish a new "Waste Management" designation and associated policies; and, (ii) to redesignate certain lands within the Town of Kincardine from 'Institutional' and 'Industrial' to 'Waste Management'. LOCA nON This Amendment applies to lands located at the southerly end of the Town of Kincardine. to the southeast of the intersection of Bruce and Valentine Avenues, and includes the existing Town landfill site together with additional lands to the north and to the east. BASIS The subject lands include the existing Town landfill site, together with adjacent lands 10 m to the north and 120 m to the east. To the west of the subject lands are the Town Sewage Lagoons, which form part of the Town's present sewage treatment plant operations. To the north there is a Town Public Utilities Commission equipment and storage yard. To the south, the subject lands abut the Town/ Township municipal boundary; while to the east. lands are used for agricultural purposes. The southerly portion of the existing Landfill Site, together with the Sewage Lagoons, are currently designated 'Institutional' in the Town Official Plan. The northerly portion of the existing Landfill Site, together with the Public Utilities Commission property and adjacent lands to the east. are currently designated 'Industrial'. Landfill sites are not specifically identified as a permitted use in either the Institutional or the Industrial designations. The capacity of the existing Town Landfill Site is limited. The County of Bruce is currently undertaking a long-term Waste Management Plan for the entire County. In order to accommodate the Town's interim short-term (5 year) waste disposal needs, various options have been examined pursuant to the Provincial Environment Assessment legislation. . . . . As a.result of these earlier initiatives, it was concluded that the preferred option for the Town is an interim expansion of the existing Landfill Site to the north and to the east. The northerly expansion is intended to accommodate a weigh scale and elements of a waste diversion facil ity. The easterly expansion is intended to provide the necessary Landfill capacity for a 5 year period. during which time it is anticipated that the County's long-term waste management planning efforts will have progressed sufficiently to allow for development of county waste management alternatives for the Town. The existing Official Plan pOlicies and Zoning By-Law regulations in effect for the Town do not reflect the Town's preferred option for meeting their current waste disposal needs. ecC · · · PART B - THE AHENDHENT INTRODUCTORY STATEMENT All of this part of the Amendment entitled Part B - The Amendment - consists of the following text and map constituting Amendment No. 5 to the Official Plan of the Town of Kincardine. DETAILS OF THE AMENDMENT 1. The Official Plan for the Town of Kincardine is hereby amended by adding the following 'Section D.7 - WASTE MANAGEMENT' thereto: D.7 WASTE MANAGEMENT D7.1 GOAL To provide for appropriate locations for waste management facilities for the Town in order that it may fully meet its waste reduction and disposal obligations. D7.2 OBJECTIVES D7.2.1 Waste Management facilities will be established in such areal s) and in such manner that ensures the protection of the environment and respects the health. safety and privacy of neighbouring property owners. D7.2.2 Waste Management facilities will be established and operated to the benef i t of all res i dents of the Town. D7.2.3 Waste Management facilities will be established to enable the Town to meet such immediate and long- term waste reduction and waste management policies and regulations as may be established from time to time by the Town, the County of Bruce and the Province of Ontario. D7.3 PERMITTED USES In the "Waste Management" classification of land the predominant use shall be for publ ic or private waste management uses. These sha 11 i nc 1 ude. but are not restricted to: a landfill site, a recycling facility, a materials recovery facility, a centralized composting faci 1 ity, a transfer station. The Town would be forced. to implement one of two options: (a) Tempotarily 8lockpiJe waste in available open areas that could be seemed such as pa~ lots or undeveloped industdal 81'ea&; or (b) Seek an emergeøq Certificate of Ap,ptOva! to continue to operate the Site, Under option (a) waste would be tempœ:ar.ily stockpiled either at the existing landfi11. or in available open spaces (e.g. undeveloped industrial areas) within the Town boundaries. The open. unprocessed waste may pose serious health. risks to both. the citizens of KincarcUne and the waste disposal operators from the introduction of rodents and associated disealK', The Medical Officer of Health. (MOR) for Bruce County has expressed concem about option (a) that would involve the uncontroUed disposal of waste within the Town. The MaR has indic:ated that such would constitute an unacceptable heath risk and therefore must be avoided. Option (b) would ensure that the waste is disposed. of in a sanitary manner. An etnergency expansion however will act cmly as a stop gap measure, and will not provide the necessary inteI:im waste management solution. The Director ~y also issue an emergency C of A if there is danger to health or safety; imp,inn'"1.\t: or iølmediate risk of imp"Înnent to the quality of the natural environment; or "injury" or "iønnectiate risk of injury" to property or to . plant or anhnallife. .An emergency C of A is intended only to bridge the gap between the closure of the landfill and the approval of the interim expansion. It is unlikely that the BA Branch Director would gram an emergency C of A for an approximate five (5) year period during which a long term waste JIUU'lapntent plan ~ developed. For the :reasons listed above, the "Do Nothing" alternative is rejected. 4.2 SITE J'ffiW LANDFILL WITHIN TOWN BOtJ:NnA ~ The Town of I<incardine is a relatively compact m¡pmm'lity with an area of approximately 769 bectues. Lands within the Town boundary were reviewed to d.etermiße whether aœas suitable in size and hydrogeology were available. The preliminary search identiñed. no independem sites within the Town that would meet current "ndfi11 standards and regulations. KINCARDINE .....----ø C PLANNING For these reascms, and because a new site would take far longer to gain approval than an interim expansion of the existing Site, the "new landfill- alternative is, therefore, rejected as an interim waste management solution. ..; 4.3 ;ayoRt9rnAm The comprehensive ....~e!'sment of alternatives included the examination of other waste disposal sites outside the Town boundaries - the export alternative. It is widely aclai.owledged that the management of solid waste is ideally undertaken by the municipality or area in whiclt the waste is produced and that it is generally less desirable to encOurage the export of waste. The desirabDity for local solutions/managesnent of local waste management problems was reœnliy reflected in policy statements of the MOE reganting the export of waste from the Greater Toronto Area. Although the export option is considered less desirable, it nonetheless was considered an alternative as a interim solution to the Town's waste management problem. For the Town to aport its waste to another Site, the following conditions would need to be met: 1. The host municipality must be willing to accept the waste. If not, the C of A must be ......_..t4Ò to include the Town of Kincardine within the service area, and the duration to adùeve the amendment would outstrip the remaining Site life; and. 3, The host site must have sufficient volume and handling facilities to rea:ite the anticipated volume of waste from the Town. In particular small sites would experience a large reduction in site life, and those with small service areas would experience the introduction of a large volume of waste that would requira significant upgrading of their existing site operations. To inYesligate the "export" alternative, the Town of I<lncardine initiated an intensive search for available landfi11.capacity within the County of Bruce and from a number of private landflll operations in Southwestern Ontario. Each potential candidate (m.unicipa1 or corporate) was contacted by letter which outlined the waste management plamùng proœss initiated by the Town and inquired if the pot$l.tial candidate would be willing to accept Town's solid waste for an interim period. The letter provided speciñc d~i1s with regard to the population of the Town, the waste generation and the approximate volume of landfill space required (Me Appendix C). Table 4.3 is a sumnwy of the municipalities (Towns, VDlages, Townships) and pñvate landfill operators contacted, along with their respecl:ive responses to the request for landfill. capacity. Beyond the closed road allowance to the west, the lands, although owned by the Town, are C01Ilpletely occupied by the Town's municipal sewage lagoons which form an integral part of the present day sewage treatment plant operation. The sewage lagoons are underlain by surfidallacustrine sands wlùch render this area undesirable for landfilling from a hydrogeologic perspective based on current landfill standards. For these reasons, alternative (a) was eliminated. b) Expansion to the South An open IXumidpal road (Le. the boundary road between the Town of Kincardine and Huron Township) abuts the southern boundary of the existing Site. !.ends to the south of that road lie within the Township of Huron and are not available for limdfill by way of interim expansion. In addition. expansion in a southerly direction would be closer to the wetland associated with the Stewart Drain than the other expansion alternatives. Finally, this configuration would result in landfill contours that would reduce visual, noise and litter impacts and enhance the integrity and maintenance of the 6na1 cover. The southerly portion of the existing landfill site, together with the sewage lagoons to the west, are now designated 'Institutional', while the northerly portion of the existing site. together with the P.U.C. lands to the north and lands to the east, are now designated 'Industrial'. Landfill sites are not specifically identified as a permitted use in either the 'Institutional' or 'Industrial' designations. 2) Zonina By-Law The sUbject lands are currently zoned a combination of '1-2 - Institutional Two' and 'D - Development' in the Town of KinCardine Comprehensive Zoning By-Law No. 1988-1. The 'Institutional' zoning category permits a pUblic or private landfill site, sewage treatment plant and lagoons and accessory uses. The' Development' Zone permi ts ex i st i ng agricultural and existing residential uses. CONCLUSXONS AND RECOMMENDATXONS: The capacity of the existing Town Landfill Site is limited. The County of Bruce is currently undertaking a long-term Waste Management Plan for the entire County. In order to accolllllOdate the Town's interim short-term (5 year) waste disposal needs. various options have been examined pursuant to the Provincial Environmental Assessment legislation.
