BY-LAW NO. 1992-42
A BY-LAW TO ENTER INTO AN AGREEMENT WITH JOHN G. CRAIG FOR
PLUMBING INSPECTION SERVICES FOR A TIIRKK YEAR TERM COMMENCING
JULY 1ST 1992.
WHEREAS the Council for The Corporation of the
Town of Kincardine agrees to renew the existing contract for
the provision of plumbing inspection services in the Town of
Kincardine.
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. That The Corporation of the Town of Kincardine enter into
an agreement with John G. Craig to provide plumbing
inspection services.

2. That the mayor and clerk be authorized to sign, on behalf
of The Corporation of the Town of Kincardine, the
agreement with John G. Craig, cited as Schedule "A",
which is attached to this by-law and to affix the Town's
Corporate seal as and when required.
3. That this Agreement shall remain in effect for a
three year term commencing July 1, 1992, provided
it is not ended by either party pursuant to the
terms and conditions of said agreement.
4. This by-law shall come into full force and effect
upon its final passage.

Inspector Appointment By-Law, 1992.

This AGREEMENT made this 18th day of June, 1992.
BETWEEN:
THE CORPORATION OF THE TOWN OF KINCARDINE
hereinafter called the "Town"
of the First Part,
-and-
JOHN G. CRAIG
hereinafter called "CRAIG"
of the Second Part.
WHEREAS the Council for The corporation of the Town of
Kincardine deems it expedient to enter into an agreement
with an individual for plumbing inspection services;
AND WHEREAS the council has advertised and received a
suitable application for such services from CRAIG;
NOW THEREFORE THIS AGREEMENT WITNESSETH THAT in
consideration of other good and valuable consideration and
the sum of TWO DOLLARS ($2.00) of lawful money of Canada,
now paid by each of the two parties hereto, (the receipt
whereof is hereby acknowledged) the parties hereto
covenant, promise and agree with each other as follows:
1 . CRAIG is hereby appointed PLUIIBIlIG INSPECTOR for the
Town of Kincardine.
2. CRAIG shall perform all the statutory duties of a
plumbing inspector under the Town's plumbing by-law,
the ontario Water Resources Act and the ontario
Plumbing Code.
3. CRAIG shall assist the chief building official in
reviewing applications and plans to ascertain
compliance with the Ontario Plumbing Code, the
Plumbing by-law, and other applicable laws.
4. CRAIG shall assist the chief building official in
carrying out required inspections of plumbing
activity in the Town of Kincardine.
S. CRAIG shall issue notices as set out in the Ontario
Water Resources Act when considered necessary by the
chief building official.
6. CRAIG shall issue completion certificates where
required under the Ontario Water Resources Act, the
comprehensive zoning by-law and the Building Code.

CRAIG shall act as a by-law enforcement officer under
the direction of the chief building official, with
respect to plumbing by-law enforcement.
The TOWN shall make available to CRAIG the existing
resources of the building department to assist in
carrying out his duties, which includes computer,
software, drafting equipment, and secretarial
assistance.

10. CRAIG shall be subject to hours of work required by
the chief building official based on the level of
building and plumbing activity in the Town.
11. CRAIG shall be remunerated for his services as
plumbing inspector pursuant to Schedule "A" attached
to and forming part of this agreement. All fees
charged by CRAIG shall include all aspects of
plumbing inspection, from plan examination to
inspections, to enforcement, and include all costs
including the use of CRAIG's vehicle, mileage, etc.
12. In the event of the fees charged by the TOWN,
with respect to plumbing inspections, should
increase so too shall the fees listed on
Schedule "A" increase, by the same percentage.
13. Remuneration shall be paid once monthly, on the
day following the third Thursday of the month, based
on CRAIG'S submitted request and approved by
the chief building official and Kincardine Town
council.
14. The term of this agreement shall be for three years,
commencing on 1st day of July, 1992, and terminating
on the 30th day of June, 1995. This agreement may be
terminated by either party upon ninety (90) days'
written notice to the other.
13. This Agreement shall enure to the benefit of and be
binding upon the parties hereto and their respective
successors and assigns.
IN WITNESS WHEREOF the Town has hereto affixed its
corporate seal attested by the hands of its mayor and clerk
this 18th day of June, 1992. CRAIG has hereunto set his
hand and seal this 18th day of June, 1992.
