BY-LAW NO. 1992-47
A BY-LAW TO AMEND BY-LAW NO. 1988-1, AS AMENDED, IN ORDER
TO REZONE PART OF LOT 19, PLAN 4, FROM R-l TO Rl-14.
WHEREAS Section 34 of the Planninq Act, R.S.O. 1990,
Chapter P.13 authorizes the councils of municipalities to enact
and amend zoning by-laws which comply with an approved official
plan;
AND WHEREAS the Council of The
Kincardine has enacted By-law No.
enacted under Section 34 of the said
Corporation of the

AND WHEREAS the Council of The Corporation of the Town of
Kincardine desires to amend By-law No. 1988-1;
AND WHEREAS this By-law complies with
Kincardine's Official Plan which was approved by
of Municipal Affairs on January 31, 1989;

NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. By-Law No. 1988-1, as amended, being the Comprehensive
Zoning By-Law of the Corporation of the Town of
Kincardine is hereby further amended by adding the
following Subsection 5.1.4.14 and 5.1.4.15 to
Subsection 5.1.4 thereof:
5.1.4.14 Notwithstanding their 'Rl' Zoning designation those
lands described as Lot 18, Plan 4, in the Town of
Kincardine and delineated as 'RI-13' on Schedule "A"
to this By-Law may be used for single family
residential purposes in compliance with the 'Rl'
Zone provisions contained in this By-Law, excepting,
however that:
(i) the 'Minimum Lot Depth' shall be 78 feet;

5.1.4.15 Notwithstanding their 'Rl' Zoning designation, those
lands described as Lot 19, plan 4, in the Town of
Kincardine and delineated as 'RI-14' on Schedule "A"
to this By-Law may be used for single family
residential purposes in compliance with the 'Rl"
Zone provisions contained in this By-Law, excepting,
however that:
(i) the 'Minimum Lot Depth" shall be 78 feet;
(ii) the 'Minimum Exterior Side Yard' shall be 16
feet for the existing building;
(iii) the 'Minimum Rear Yard' shall be 6.3 feet for
the existing building.

2. Schedule "A" to By-Law No. 1988-1, as amended, is
hereby further amended by changing thereon from 'R1'
to 'Rl-13' and from 'R1' to 'Rl-14' the zoning
designation of Lots 18 and 19 , Plan 4, (legally known
as 1028 Huron Terrace), in the Town of Kincardine and
shown outlined in the heaviest black broken line on
the attached Schedule "A".

This by-law shall take effect from the date of final
passage by Council and comes into full force and effect
pursuant to the provisions of the Planninq Act.
