BY-LAW NO. 1992-57
A BY-LAW TO CLOSE PART OF HURON TERRACE FOR CONSTRUCTION.
WHEREAS The Corporation of the Town of Kincardine has
authorized construction on part of Huron Terrace which is a
public highway opened for public use;
AND WHEREAS the access to Huron Terrace from Harbour
Street will be restricted temporarily during the construction
on Huron Terrace;
AND WHEREAS Subsection 208(43) of the Municipal Act,
R.S.C. 1980, Chapter 302, as amended, authorizes the councils
of all municipalities to close on a temporary basis any highway
under the jurisdiction of the municipality for any period
during the construction, repairing or improvement of such
highway or portion thereof;
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:

2. That Harbour street east of Huron Terrace will be deemed
a two way street with no parking on either side, and
furthermore, access to Queen street will be limited to
right hand turns only during the period of construction
when egress to Huron Terrace is not possible as
authorized by By-Law No. 1992-56.
3. That Harbour street west of Huron Terrace will be closed
to local vehicular traffic during the period of
construction authorized by By-Law No. 1992-56.
4. A suitable alternate area for the loading and unloading
of buses which would normally occur on Harbour street
will be established by the Town Engineer.

The contractor shall provide and keep in repair all
reasonable alternative temporary routes for traffic and
for all property owners who cannot obtain access to their
property by reason of such closing.

A temporary road will be established by the contractor
and approved by the town engineer though the McPherson
Park adjacent to the part of Harbour street west of Huron
Terrace, in order to allow residents and emergency
vehicles access to properties located on the closed
portion of the road.
7. The contractor shall erect at each end of such highway or
portion thereof, and where an alternative route deviates
therefrom, a barricade upon which an adequate warning
device shall be exposed and in good working order
continuously from sunset until sunrise and at such points
there shall be erected a detour sign indicating the
alternative route and containing a notice that the
highway is closed to traffic.

8. Every person who without lawful authority uses a highway
or portion thereof so closed to traffic while it is
protected in accordance with this paragraph, or who
removes or defaces any barricade, device, detour sign or
notice placed thereon by lawful authority , is guilty of
an offence and is subject to the penalties as set forth
in the provincial Offences Act and is also liable to the

or injury occasioned by such wrongful use, removal or
defacement.
9. This by law shall come into full force and effect upon
its final passage.
10. This by-law may be cited as the "Temporary Closure of
Huron Terrace By-law".

READ a THIRD time and FINALLY PASSED this 6th day of August,
1992.
