':f;" "":;;¡;J"'6 BY-LAW BY-LAW NO. 1992-58 A BY-LAW TO AUTHORIZE A WASTE MANAGEMENT IMPROVEMENT PROGRAM, INCLUDING ENVIRONMENTAL ASSESSMENT PROCEDURES FOR THE EXPANSION OF THE TOWN OF KINCARDINE'S LANDFILL SITE, IMPROVEMENTS TO THE EXISTING SITE, AND RELATED WORKS AND EQUIPMENT, AND THE BORROWING OF UP TO $912,807 UPON DEBENTURES. WHEREAS the Council for The Corporation of the Town of Kincardine has deemed it necessary to authorize the commencement of a waste management improvement program in the Town of Kincardine, consisting of an expansion to the Town's landfill site, a waste management improvement program for the existing site, and related works and equipment at an estimated cost of $912,807. AND WHEREAS section 210 (89) (a) of the Municipal Act, R.S.a. 1990, chapter m.45 permits the councils of local municipalities to authorize the work hereinafter set forth. AND WHEREAS the Council for The Corporation of the Town of Kincardine by a vote of an affirmative vote of at least three-fourths of all members of Council, ENACTS as follows: 1. In this By-law, "work" shall mean that described on Schedule "A" attached to this by-law at an estimated cost of $912,807. 2. The undertaking of the said work, the exercise of the powers of The Corporation of the Town of Kincardine to proceed therewith, and the prov~s~ons of monies therefor, by the issue of debentures is hereby approved and authorized in the amount not exceeding $ repayable over six (6) Years. 3. The Treasurer of The Corporation of the Town of Kincardine may (subj ect to approval of council) agree with any bank or person for temporary advances of money to meet the costs of the work pending the completion thereof. 4. The work shall be carried on and executed under the supervision and according to the directions and orders of the Town's consulting engineers for waste management, Conestoga Rovers & Associates Limited. . 5. In each year in which an instalment on the said debentures becomes due, the amount to be raised shall be paid from the revenue fund of The Corporation of the Town of Kincardine in each year until the debt has been retired. .. ./2 . . Page 2 By-law No. 1992-58 6. That By-law No. 1992-45 passed on the 2nd day of JUly, 1992 be and the same is hereby repealed. This By-law shall not come into force and effect until approval of the Ontario Municipal Board has been obtained pursuant to Section 64 of the ontario Municipal Board Act, R.S.O. 1990, chapter 0.28, and shall come into force and effect upon such approval being given. 8. This by-law may be cited as the "Environmental Assessment for Landfill site Expansion and Improvement Debenture By-law" . 7. READ a FIRST and SECOND time this 6th day of August, 1992.
