Pook (Warden, Church of the essiah) and Diane MacLeod, S pt Lot 9 (being Part 2 on RP 3R-3724), Municipality of incardine (former Town of Kincardine) [lands to be severed and retained] and art of Park Lot 4 Russell NIS (being Part 1 on RP 3R-3724), Municipality of Ki cardine (former Town of Kincardine) [church lands -lands being a ded to] I WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chaptrr 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws w ich comply with an approved official plan; AND WHEREAS the Council of the Corporation of the MuniCiPa*i of Kincardine has enacted By-law 2003-25, a zoning by-law enacted under Se ion 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Munic pality of Kincardine desires to amend By-law 2003-25; NOW THEREFORE the Council of the Corporation of the Muni ipality of Kincardine ENACTS as follows: Schedule 'A' to By-law No. 2003-25 as amended, is hereby rther amended by changing thereon from 'R1' to 'I-b' the zoning designation of those lands described as S Pt Lot 9 (being Part 2 on RP 3R-3724), Muni ipality of Kincardine (former Town of Kincardine); from '08' to 'I-b' the zoning de ignation of those lands described as Part of Park Lot 4 Russell NIS (being Pa 1 on RP 3R-3724), Municipality of Kincardine (former Town of Kincardine); and rom 'R1' to 'R1-y' the zoning designation of those lands described as 8 Pt Lot 9 (being Part 2 on RP 3R-3724), Municipality of Kincardine (former Town of Ki cardine) which are. outlined on the attached Schedule 'A'. 1. 2. By-Law No. 2003-25, as amended, being the Comprehensi e Zoning By-Law for the Municipality of Kincardine, is hereby further amended b adding the following paragraph to subsection 31.4 thereof: 31.4.2 Notwithstanding their 'I' Zoning designation, t ose lands delineated as 'I-b' on Schedule 'A' to this By-law may be sed for 'Institutional' purposes in compliance with the 'I' Zone p visions contained in this By-law, excepting however, that: . . ./2 e e e e Page 2 Amendment to Zoning By-law No. 2003 - 25 - Diocese qf Huron By-law No. 2004 - 169 . (i) The minimum side yard setback shall bEj 1.8 metres for the church building existing as of the date ofl passage of the By- law. . 3. By-Law No. 2003-25, as amended, being the ComprehensivelZoning By-Law for the Municipality of Kincardine, is hereby further amended by ~dding the following paragraph to subsection 12.3 thereof: Notwithstanding their 'R1' Zoning designa~ion, those lands delineated as 'R1-v' on Schedule 'A' to this By-I~w may be used for 'Residential' purposes in compliance with the '1R1' Zone provisions contained in this By-law, excepting however, thc1t: (i) The minimum side yard setback shall b~ 0.3 metres for the residential building existing as of the datþ of passage of the By-law; and . (ii) The minimum lot frontage shall be 13. 7 ~etres. 4. This By-law takes effect from the date of passage by Council ~nd comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 12.3.22 5. This By-law may be cited as the "Amendment to Comprehen~ive Zoning By-law 2003-25, (S pt Lot 9 (being Part 2 on RP 3R-3724), Municipality of Kincardine (former Town of Kincardine) [lands to be severed and retainep] and Part of Park Lot 4 Russell N/S (being Part 1 on RP 3R-3724), Municipalitylof Kincardine (former Town of Kincardine) [church lands -lands being add~d to]), By-Law'.
