THE MINISTRY OF TOURISM AND RECREATION ACT, R.S.O. 1990, c.M.35 AND PROVIDE FOR THE ESTABLISHMENT, OPERATION AND MAINTENANCE OF COMMUNITY CENTRES, UNDER. THE COMMUNITY RECREATION CENTRES ACT, R.S.O. 1990, c.C.22, AND THE REGULATIONS MADE UNDER. THE ACT. WHEREAS the Council for The Corporation of the Town of Kincardine deems it expedient to establish a committee to establish and operate a program of recreation in the Town of Kincardine and in any other municipality which makes an agreement for the provision of recreation services with the Town. NOW THEREFORE the Council for The Corporation of the Town of Kincardine (hereinafter called the Town) ENACTS as follows: 1.0 ESTABLISH COMMUNITY PROGRAM OF RECREATION 1.1 Under the regulations made under the Ministry of Tourism and Recreation Act, R.S.O. 1990, c.M.35, a community program of recreation is hereby established for the residents of the Town of Kincardine and the residents of any other municipality which makes an agreement for the provision of recreation services with the Town. 1.2 Under the Community Recreation Centres Act, R.S.O. 1990, c.C.22, and regulations made thereunder,a Community Centre known as the Davidson Centre for "Kincardine and District" (hereinafter called the Davidson Centre) is hereby established for the residents of the Town of Kincardine and the residents of any other municipality which makes an agreement for the provision of community centre services with the Town. 2.0 KINCARDINE AND DISTRICT RECREATION COMMITTEE 2.1 Subject to the provisions of this bylaw, the policies concerning the said community program of recreation and the Davidson Centre shall be directed, managed and controlled, on behalf of the Council for The Corporation of the Town of Kincardine, by a committee known as the Kincardine and District Recreation Committee (hereinafter called the "Committee"). . 2.2 The Committee shall be appointed from time to time, by resolution of the respective councils, as follows: 2.2.1 Two members of the Council of the Town. 2.2.2 Two qualified residents of the Town of Kincardine to be elected as members of Council. who are {\ .",J,J 1111'~ q ;;L \i1C1 d-~ .. ./2 By-law No. 1992-71 Recreation Committee By-law Page 2 . 2.2.3 The appointment of Council members shall be for a term as established by the appointing resolution of Council and shall not exceed the term of Council. The appointment of non-Council members shall be for a two-year term, and, where possible, these terms shall be staggered to ensure continuity on the Committee. 2.2.6 The mayor of the Town shall be a member of the Committee by virtue of office. 2.3 In carrying out the provisions of this by-law, the Committee shall, at all times, be the agent of the Town and while acting within the limits of the authority of this by-law, neither the Committee nor any member thereof shall incur any liability by reason of anything done or left undone by the Committee; provided, however, that nothing in the paragraph contained shall authorize or empower the Committee to incur any debt, liability or obligation for which the Town shall become liable, without previously obtaining the consent of the Council of the Town. The Committee may not enter into any contracts but may recommend approval to the council of the Town. 2.4 The Committee shall be responsible for all policies relating to the operation of the community program of recreation and Davidson Centre which are delegated to it by this by-law and rules and regulations pertaining to the proper conduct of such community programs of recreation and Davidson Centre subject to the approval of Council. 2.5 The Committee shall meet monthly on a date to be set by the Committee. 2.6 The Committee may establish whatever sub-committees it requires to fulfill its responsibilities. 2.7 The Committee shall provide an annual report together with any other reports requested by the Council for the Town. The Committee shall also provide the minutes of all meetings of the Committee to the Council for the Town for its approval. 2.8 Subject to the pOlicies of the Council of the Town, Committee shall prescribe user fees for admittance rentals of facilities and programs in order to meet approved budget projections. the and its .../3 . By-law No. 1992-71 Recreation committee By-law Page 3 3.0 PERSONNEL . 3.1 Unless otherwise provided for in this by-law, personnel practices shall be in accordance with provisions of the Consolidated Personnel By-law. all the 3.2 The hiring of manager shall the Town and administrator. the director of recreation and facilities be the responsibility of the Council for they shall be under the direction of the 3.3 The director of recreation and facilities manager shall recommend to the Council of the Town through the Committee the appointment of all permanent employees who shall be responsible to the director of recreation and facilities manager. 3.4 The appointment of casual part-time and seasonal recreation and Davidson Centre workers shall be in accordance with the provisions of the Town's Consolidated Personnel By-law. No casual employee shall have a combined term of employment beyond six months without the approval of Council. 3.5 The Committee shall submit to the treasurer of the Town an annual budget for the approval of the Council for the Town in accordance with the instructions and timetable of Council. 3.6 All receipts and disbursements shall be made thought the Town's treasurer as regulated by the Municipal Act. 3.7 The Committee may solicit or receive, on behalf of the Town, any gifts or bequests of money or services or any donations to be applied, principal or income, for either the temporary or permanent use of the facilities, equipment, programs or other recreational purposes. 4.0 PROGRAM AND PLANNING 4.1 The Committee shall encourage, assist and, where necessary, conduct the programs of recreation which will meet the needs and interests of the citizens and municipalities represented on the Committee. Such programs shall include the social, cultural and physical needs of the citizens as applied to each age group, both male and female. 4.2 The Committee shall assist in the co-ordination of community recreation activities. 4.3 The Committee shall assist, encourage and provide advisory services on request to all groups, organizations or persons carrying on recreation activities for the municipalities represented on the Committee. The Committee shall, at all times, keep the inhabitants of the municipalities represented on the Committee aware of the recreation opportunities which are available and will continually interpret to the public the total program of recreation. . 4.4 .. ./4 . .
