THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW
BY-LAW NO. 1992-79
A BY-LAW TO CLOSE PART OF QUEEN STREET FOR CONSTRUCTION.
WHEREAS The Corporation of the Town of Kincardine has
authorized construction on part of Queen Street which is a
public highway opened for public use;
AND WHEREAS Subsection 208(43) of the Municipal Act,
R.S.O. 1980, Chapter 302, as amended, authorizes the councils
of all municipalities to close on a temporary basis any highway
under the jurisdiction of the municipality for any period
during the construction, repairing or improvement of such
highway or portion thereof;
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. That part of Queen Street will be closed to local
vehicular traffic during the period of construction
authorized by By-law No. 1992-78.
2. That Queen Street from the bridge to Durham Street will
be closed to local vehicular traffic during the period of
construction authorized by By-Law No. 1992-78
The contractor shall provide and keep
reasonable alternative temporary routes
for all property owners who cannot obtain
property by reason of such closing.
4. The contractor shall erect at each end of such highway or
portion thereof, and where an alternative route deviates
therefrom, a barricade upon which an adequate warning
device shall be exposed and in good working order
continuously from sunset until sunrise and at such points
there shall be erected a detour sign indicating the
alternative route and containing a notice that the
highway is closed to traffic.

Every person who without lawful authority uses a highway
or portion thereof so closed to traffic while it is
protected in accordance with this paragraph, or who
removes or defaces any barricade, device, detour sign or
notice placed thereon by lawful authority , is guilty of
an offence and is subject to the penalties as set forth
in the Provincial Offences Act and is also liable to the

or injury occasioned by such wrongful use, removal or
defacement.
7. This by law shall come into full force and effect upon
its final passage.
8. This by-law may be cited as the "Temporary Closure of
Queen street By-law".
READ a FIRST, SECOND and THIRD time and FINALLY PASSED this
17th day of September, 1992.
