BY-LAW NO. 1992-83
A BY-LAW TO AUTHORIZE THE SIGNING OF A LEASE AGREEMENT
CONCERNING THE SHARING OF HOCKEY GATE RECEIPTS.
WHEREAS the Council for The Corporation of the
Town of Kincardine deems it advisable to enter into a lease
agreement¡
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. That The Corporation of the Town of Kincardine enter into
an agreement with the Kincardine Kings Hockey Club to
use the Davidson Centre and establish the share of the
Town's gate receipts.
2. That the mayor and clerk be authorized to sign, on behalf
of The Corporation of the Town of Kincardine, the
agreement with Kincardine Kings Hockey Club which is
attached to this by-law and to affix the Town's Corporate
seal as and when required.
3. This by-law shall come into full force and effect upon
its final passage.
4. This by-law may be cited as the "Kincardine Kings
Agreement By-law".
READ a FIRST and SECOND time this 17th day of September,
1992.

hereinafter called the "Town"
of the First Part,

KINCARDIlŒ KINGS HOCKEY CLUB
herinafter called the "Club"
of the Second Part.
WBBRBAS the Town deems it advisable to enter into a rental
agreement with the Club¡
NOW TBBRBI'ORB THIS ~.1DIIlIft WITNBSSBTB THAT in considera-
tion of the premises and mutual promises and covenants
hereinafter contained, the parties hereby agree as follows:
1. The Kincardine Kings Hockey Club and The corporation
of the Town of Kincardine agree to the financial
arrangement that the gate at all exhibition, regular
and play-off games be split 60-40 with $195.00
minimum, $700.00 maximum payment to the Town. The
split will occur after referees, ticket taker, ticket
seller, W.o. A.A. expenses, police (if necessary) plus
payment to the visiting team have been deducted. The
Club will receive 60% and the Town 40% of the gate
after expenses. The Club will provide the ticket
taker and the Town will supply the ticket seller.
2. The Club will receive a one hour practice per week at
no charge for pre-season exhibition, regular schedule
and play-off games. The practice time will be
specified prior to the beginning of the season.
3. Police security is at the discretion of the Town.
4. Blue Line Clubs held in conjunction with all games are
to be split 60-40 (club receiving 60% and the Town
40%) after all expenses are paid for which either the
Meeting Room and the Sun Room or Kincardine Room will
be made available. The Club shall be responsible for
the operation of the Blue Line Club, the conduct of
all patrons, and ensure that compliance to the rules
and regulations established in the Liquor License
Control Act are strictly enforced.
5. The Club and The town are to mutually agree upon the
setting of admission prices.
6. This agreement is only valid for the 1992-1993 hockey
season. The agreement is negotiable annually with a
negotiating deadline being the second Monday in June.

Rental payments and/or splits will be payable to the
Town following each game or practice with no
exceptions. Default of any such payment may render
this agreement null and void.
