THE CORPORATION OF THE TOWN OF KINCARDINE

BY-LAW NO. 1992-16
A BY-LAW TO REGULATE THE DISCHARGE OF GUNS AND OTHER
FIREARMS IN THE TOWN OF KINCARDINE.
WHEREAS Subsection 210 (36) of the Municipal Act, R.S.D. 1990,
c.M.45, as amended, authorizes the councils of local
municipalities to pass by-laws for prohibiting or regulating
the discharge of guns or other firearms, air-guns, spring-guns,
cross-bows, long-bows or any class or type thereof in the
municipality or in any defined areas thereof for the purposes
of public safety.

use of such fire-arms within the Town of Kincardine.
NOW THEREFORE the council for The Corporation of the Town of
Kincardine ENACTS as follows:
1. No person, without lawful excuse, shall, use or discharge
any gun or other fire-arm, or any other class or type
thereof within the boundaries of the Town of Kincardine.
2. No person, without lawful excuse, shall handle, carry or
store in a careless manner any gun or other fire-arm, or
any other class thereof within the boundaries of the Town
of Kincardine.
3. Notwithstanding the provisions of Paragraph 1 above, a
duly appointed police officer, provincial offences
officer or by-law enforcement officer may, in the
exercise of his or her lawful duty, discharge a fire-arm
within the boundaries of the Town of Kincardine.

4. No person, without lawful excuse, shall use, carry,
handle, store or discharge in a careless manner any air
gun, spring gun, sling-shot, or any class or type
thereof, within the boundaries of the Town of Kincardine.
5.
No person, without lawful excuse, shall use, carry,
handle, store or discharge in a careless manner any
crossbow, longbow, recurve bow, compound bow or any type
or class thereof within the boundaries of the Town of
Kincardine.

Every person who contravenes any provisions of
by-law is guilty of an offence and is subject to
penalties as prescribed in the Provincial offences
R.S.D. 1990, c.P.33, as amended.

7. By-law Number 4608 passed on the 5th day of July, 1984,
be and the same is hereby repealed.
8. This by-law shall come into full force and effect upon
its final passage.
9. This by-law may be cited as the "Fire-arms Regulation
By-law" .
