HomeMy WebLinkAboutKIN 93 078 Est. Dep Bldg Permit . . THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW BY-LAW NO. 1993-78 A BY-LAW BUILDING STRUCTURE. TO ESTABLISH A DEPOSIT IN FOR THE ISSUANCE OF PERMITS FOR NEW RESIDENTIAL OR COMMERCIAL AND WHEREAS the Chief Building Official for the Town of Kincardine is authorized to issue building permits; AND WHEREAS the Chief Building Official is obligated to inspect projects for which the issuance of a building permit is required to ensure that projects satisfy the requirements of any provincial statute; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1.0 DEFINITIONS 1.1 Applicant shall mean the person listed on the building permit as owner or authorized agent. 1.2 Chief Buildina Official shall mean the Chief Building Official for The Corporation of the Town of Kincardine, or any person designated by Council, from time to time. The chief building official may delegate his/her responsibilities to the building inspector. 1.3 Deposit - shall mean a sum of money held by the Town of Kincardine until such time as the project is completed to the satisfaction of the Chief Building official. 1.4 Final Inspection - shall mean the final inspection of the chief building official that ensures that all finishing work on any structure is complete. 1.5 Gradina Inspection - shall mean the out by the chief building official sufficient drainage is established a new structure. inspection carried that ensures that in the area around 1.6 Occupancv Inspection shall mean the inspection carried out by the chief building official that deems any structure suitable for human habitation. 1.7 Owner - shall mean the owner of the lands upon the new residential or commercial structure is erected. which being ../2 New Residential or Commercial structure Deposit By-Law Page 2 1.9 Person shall mean any human being, chartered organization, firm, partnership, corporation, agent or trustee, and the heirs, executors or other legal representatives of a person to whom the context can apply according to law. . 1.10 Refund shall mean the giving back in whole or in part of any deposit. 1.11 Town shall mean The Corporation of the Town of Kincardine. 2.0 COLLECTION OF DEPOSITS 2.1 Upon issuance of a building permit for a new residential, commercial, industrial or institutional structure, the chief building official shall collect from the applicant or owner a deposit, which sum is to be established by the Town's Consolidated Fee By-Law. 3.0 REFUND STRUCTURE 3.2 Deposits shall be refunded in three stages. 3.2.1 The first refund applicant or owner grading inspection. shall be made to the upon completion of the 3.2.2 The second refund shall be made to the applicant or owner upon completion of the occupancy inspection.
