BY-LAW
BY-LAW NO. 1993-77
A BY-LAW TO AUTHORIZE THE SIGNING OF AN AGREEMENT WITH STEVEN
NISBETT FOR THE PROVSION OF SMALL ANIMAL CONTROL SERVICES
WHEREAS the Council for The Corporation of the Town of
Kincardine deems it advisable to enter into an agreement with
steven Nisbett for the provision of Small Animal Control
services for the Town of Kincardine;
NOW THEREFORE the Council for The Corporation of the Town
of Kincardine ENACTS as follows:
1. That The Corporation of the Town of Kincardine enter into
an agreement with Steven Nisbett to provide Small Animal
Control Services for the Town of Kincardine.
2. That the mayor and clerk be authorized to sign, on behalf
of The Corporation of the Town of Kincardine, the
agreement with Steven Nisbett which is attached to this
by-law and to affix the Town's Corporate seal as and when
required.
3. This by-law shall come into full force and effect upon
its final passage.
4. This by-law may be cited as the "Steven Nisbett as Small
Animal Control Officer Agreement By-law".

hereinafter called the "Town"
of the First Part,

hereinafter called "NISBETT
of the Second Part.
WHEREAS the Council for The Corporation of the Town of
Kincardine deems it expedient to enter into an agreement
with an individual for small animal control services;
NOW THEREFORE THIS AGREEMENT WITNESSETH THAT in considera-
tion of the premises and mutual promises and covenants
hereinafter contained, the parties hereby agree as follows:
1. For the purposes of this agreement:

It shall be the duty of the SMALL

4. The SMALL ANIMAL CONTROL OFFICER shall have all
necessary authority for the seizure and impounding of
small animals as may be required by the said by-laws
or acts and shall take instructions from the
chairperson of the committee for the Protection to
Persons and Property or in his/her absence the
clerk-administrator of the Town of Kincardine.

5. a) The SMALL ANIMAL CONTROL OFFICER shall work a
minimum of 15 hours a week, of which he shall patrol
not less than 3 hours per day and not less than 4 days
per week.
b) The SMALL ANIMAL CONTROL OFFICER is required to
notify the police when he has impounded any animal,
along with the description of said animal.
The SMALL ANIMAL CONTROL OFFICER shall, in addition to
his normal patrol, be responsible for the care of all
animals so impounded in the TOWN's small animal
shelter and be responsible for the cleanliness of said
shelter pursuant to provincial regulations.
6.
Duties of the SMALL ANIMAL CONTROL OFFICER are
appended as Schedule "B".
7. Cost of feeding and destroying the impounded animals
shall be borne by the TOWN with the invoices submitted
in the name of the Town of Kincardine to the
treasurer's office for payment.

8. The SMALL ANIMAL CONTROL OFFICER shall, at his own
expense:
a) supply transportation in the performance of his
duties.

The SMALL ANIMAL CONTROL OFFICER shall have the
co-operation of the Town of Kincardine when issuing a
summons.
10. The term of this agreement shall be for three years,
commencing the first day of January, 1994, and
terminating on the 31st day of December, 1996. This
agreement may be terminated by either party upon
ninety (90) days' written notice to the other.
11. This agreement may re-negotiated in the event that the
boundaries of the Town are altered during the term of
this agreement.
12. The SMALL ANIMAL CONTROL OFFICER shall be paid at the
rate of $1,000 per month for the duration of this
agreement.
IN WITNESS WHEREOF the Town has hereto affixed its
corporate seal attested by the hands of its mayor and clerk

DUTIES OF SMALL ANIMAL CONTROL OFFICER
Maintain every room in the pound in a clean condition.
Ensure that the pound is adequately ventilated.
Ensure that adequate heat is provided for the comfort
of every animal in the pound.
Ensure that every animal is properly identified and
that a complete record is maintained on each animal.
Pens are to be properly sanitized.
Properly clean and flush any gutter or drain in the
pound.
Ensure that adequate lighting is provided in the
pound.
The following method shall be used in cleaning the
pens.
a) Loose feces or urine to be removed from the pen.
b) Fecal material and dirt should be removed from
walls and floors of the pen by using a stiff
bristled broom or handbrush.
c) Pen walls, floor and rest board should be
sprayed with a suitable disinfectant.
d) The entire pen should be rinsed with hot water.
e) Pen doors should be sanitized in a similar
manner.
f) The floor area of the pen should be squeegeed to
remove excess water.
g) Animal to be removed from their cages during the
cleaning procedure.
9. Adequate amounts of suitable food and water are to be
provided to each animal.
10. Every container for feed or water shall be maintained
in a sanitary condition.

reported to the nearest office of the ontario
for the Prevention of Cruelty to Animals,
Society affiliated therewith.
12. Dispose of animals following the minimum redemption
period which shall not be less than three days,
excluding the day on which the animal was impounded
and any holidays.

15. The SMALL ANIMAL CONTROL OFFICER shall enforce the

the Town twice weekly in the early morning and early
evenings, on a regular basis, during the period for
which the by-law is in effect.

The SMALL ANIMAL CONTROL OFFICER shall submit to
clerk's office no later than the 2nd day of
month, a written statement of his activities for
past month on the prescribed form.
17. The SMALL ANIMAL CONTROL OFFICER shall annually, in
December, advertise the Cat By-Law.
