Home My WebLink About07 342 Dedicate an extension to Durham St as part of the Public Highway System for MoK . . . . :-fHIE TJH[E NO. 2007 - 342 BEING A BY-LAW TO DEDICATE AN EXTENSION TO DURHAM STREET AS PART OF THE PUBLIC HIGHWAY SYSTEM FOR THE MUNICIPALITY OF KINCARDINE WHEREAS Section 31 (2) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that land may only become a highway by virtue of a by-law establishing the highway; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine is the owner of certain lands, being more particularly described as follows: Part of Lots 2 and 3 Concession 1 South of the Durham Road, Geographic Township of Kincardine, Municipality of Kincardine, County of Bruce, designated as Part 1, Part 9 and Part 10 on Reference Plan 3R-8544; AND WHEREAS it is desirous to accept and dedicate the aforementioned lands as part of the Municipality's public highway system; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. The Corporation of the Municipality of Kincardine does hereby establish, assume and dedicate these lands as a highway. The said lands described in Schedule "A" attached to this by-law are hereby accepted and dedicated as part of the highway system of the Municipality of Kincardine. 3. That this by-law shall become effective upon its final passage by the Council of the Municipality of Kincardine and upon its registration in the Registry Office for the Registry division of Bruce (No.3). 2. 4.
